HomeMy WebLinkAbout76-88 - Intention to Dispose of Surplus Real PropertyRESOLUTION NO. 76-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO DISPOSE OF SURPLUS REAL PROPERTY; DESCRIBING THE LAND TO BE SOLD; SETTING FORTH IN GENERAL TERMS THE INTEREST EASEMENTS OR RESERVATIONS TO BE RESERVED BY THE PUBLIC, IF ANY; SETTING THE TIME AND PLACE OF THE SALE; ESTABLISHING TERMS AND CONDITIONS OF THE SALE; AND CALLING FOR SEALED BIDS IN WRITING. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, Title I, Division I, Chapter I, Article 4.5, Sec- tions 190 through and including 196 of the Government Code, provides for a method for the disposition of surplus real property of a local agency; and WHEREAS, the City has as surplus lands described on an exhibit attached to this Resolution, marked Exhibit "A", and by this specific reference made a part hereof; and WHEREAS, said lands are more particularly described in a plat marked Exhibit "B", attached to this Resolution and by this specific reference made a part hereof; and WHEREAS, the City desires to dispose of said lands to the highest bidder; NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid statutory authority, the City does hereby offer for sale the real property described in Exhibit "A" attached hereto, and as more particu- larly described in the plat marked Exhibit "B" attached hereto. BE IT FURTHER RESOLVED that said sale shall be in accordance with the terms and conditions as set forth in the Notice of Sale at Public Auction attached to this Resolution, marked Exhibit "C", and to the Condition of the Title described in Exhibit "D", both by this specific reference made a part hereof. BE IT FURTHER RESOLVED that Notice of Sale be published in the Orange Coast Daily Pilot once a week for four (4) consecutive weeks, said notice to be published pursuant to Section 6064, Goverment Code, and to contain a description of the land or lands to be sold, general terms including interests or easements or reservations to be reserved by the City, the time and place of sale, and a call for sealed bids in writing. BE IT FURTHER RESOLVED that all bids shall be filed with the City Clerk of the City of Costa Mesa on or before 10:00 a.m. on the 13th day of September, 1976. BE IT FURTHER RESOLVED that the opening of said bids shall take place at the hour of 10:00 a.m. in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California, on the 13th day of September, 1976. BE IT FINALLY RESOLVED that the money derived from said sale be forthwith paid into the fund from which payment was made for the land. NOTICE OF SALE AT PUBLIC AUCTION WHAT: Public sale of a C-2 zoned vacant parcel of land containing approxi- mately 11,759 square feet, net, located at 129-133 East 17th Street in the City of Costa Mesa (see attached map marked EXHIBIT "B").
