A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO DISPOSE OF SURPLUS REAL PROPERTY; DESCRIBING
THE LAND TO BE SOLD; SETTING FORTH IN GENERAL
TERMS THE INTEREST EASEMENTS OR RESERVATIONS TO
BE RESERVED BY THE PUBLIC, IF ANY; SETTING THE
TIME AND PLACE OF THE SALE; ESTABLISHING TERMS
AND CONDITIONS OF THE SALE; AND CALLING FOR
SEALED BIDS IN WRITING.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, Title I, Division I, Chapter I, Article 4.5, Sec-
tions 190 through and including 196 of the Government Code, provides for
a method for the disposition of surplus real property of a local agency;
and
WHEREAS, the City has as surplus lands described on an exhibit
attached to this Resolution, marked Exhibit "A", and by this specific
reference made a part hereof; and
WHEREAS, said lands are more particularly described in a plat
marked Exhibit "B", attached to this Resolution and by this specific
reference made a part hereof; and
WHEREAS, the City desires to dispose of said lands to the highest
bidder;
NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid
statutory authority, the City does hereby offer for sale the real
property described in Exhibit "A" attached hereto, and as more particu-
larly described in the plat marked Exhibit "B" attached hereto.
BE IT FURTHER RESOLVED that said sale shall be in accordance with
the terms and conditions as set forth in the Notice of Sale at Public
Auction attached to this Resolution, marked Exhibit "C", and to the
Condition of the Title described in Exhibit "D", both by this specific
reference made a part hereof.
BE IT FURTHER RESOLVED that Notice of Sale be published in the
Orange Coast Daily Pilot once a week for four (4) consecutive weeks,
said notice to be published pursuant to Section 6064, Goverment Code,
and to contain a description of the land or lands to be sold, general
terms including interests or easements or reservations to be reserved by
the City, the time and place of sale, and a call for sealed bids in
writing.
BE IT FURTHER RESOLVED that all bids shall be filed with the City
Clerk of the City of Costa Mesa on or before 10:00 a.m. on the 13th day
of September, 1976.
BE IT FURTHER RESOLVED that the opening of said bids shall take
place at the hour of 10:00 a.m. in the Council Chambers of City Hall, 77
Fair Drive, Costa Mesa, California, on the 13th day of September, 1976.
BE IT FINALLY RESOLVED that the money derived from said sale be
forthwith paid into the fund from which payment was made for the land.

That portion of Lot 82 of Newport Heights, as shown on a map
thereof recorded in Book 4, Page 83 of Miscellaneous Maps, records of
Orange County, California, described as follows:
BEGINNING at the centerline intersection of Fullerton Avenue and
17th Street; thence north 49°58'52" west along the centerline of 17th
Street a distance of 456.61 feet, more or less, to the intersection with
the northeasterly prolongation of the easterly line of that certain
parcel acquired by the State of California by Deed 45926, recorded in
Book 8643, Page 113 of Official Records of Orange County; thence south
40°01'08" west along said northeasterly prolongation a distance of 40.00
feet to the TRUE POINT OF BEGINNING; thence continuing south 40°01'08"
west a distance of 88.47 feet to a point of intersection with a curve
concave southerly having a radius of 703.00 feet, a radial through said
point bears south 00°29'10" east; thence westerly along said curve
through a central angle of 04°23'26" an arc distance of 53.87 feet to a
point on the southwesterly line of said land acquired by the State of
California, a radial through said point bears south 04°52'36" east;
thence north 49°58'52" west along said southwesterly line a distance of
60.42 feet to the westerly corner of said land acquired by the State;
thence north 40°01'O8" east along the northwesterly line of said land
acquired by the State a distance of 125.00 feet to a point 40.00 feet
southwesterly of the centerline of said 17th Street, as measured at
right angles; thence south 49°58'52" east along a line parallel and
40.00 feet southwesterly of said centerline of 17th Street a distance of
100.00 feet to the TRUE POINT OF BEGINNING.
EXCEPTING AND RESERVING THEREFROM a perpetual easement for public
street and highway purposes over, under, across, and through the most
northeasterly 7.00 feet of the above described portion of Lot 82.
For the purpose of this description, it is intended that the most
southwesterly line of the above described 7.00 feet is coincident with a
line parallel and 47.00 feet southwesterly of the centerline of 17th
