A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, ORDERING THE VACA-
TION OF A PORTION OF LOT A, BANNING TRACT,
LOCATED AT THE NORTHWEST CORNER OF FAIRVIEW
ROAD AND ARLINGTON DRIVE.
WHEREAS, the City Council of the City of Costa Mesa did, on the
7th day of September, 1976, pass and adopt Resolution No. 76-109,
entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION
OF LOT A, BANNING TRACT, LOCATED AT THE NORTHWEST CORNER OF FAIRVIEW
ROAD AND ARLINGTON DRIVE; and
WHEREAS, pursuant to said Resolution of Intention the time and
place for hearing all persons interested in or objecting to the proposed
vacation was set for Monday, the 4th day of October, 1976, at the hour
of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa
Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section
8300 et seq. of the Streets and Highways Code of the State of Cali-
fornia; and
WHEREAS, said date of hearing coming on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing
was closed on the 4th day of October, 1976; and
WHEREAS, the City Council of the City of Costa Mesa finds and
determines, from all the evidence submitted, that the hereinafter
described right-of-way is unnecessary for present or prospective street
purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES
ORDER AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right -of --way is unnecessary for
present or prospective street purposes.
2. It is hereby ordered that the following described right-of-way
be, and the same is hereby vacated:
A portion of that certain street and highway easement conveyed to
the City of Costa Mesa by deed recorded July 19, 1963, in Book
6638, Page 447, Official Records of Orange County, California,
lying within Parcel No. 1 as shown on a Record of Survey filed in
Book 19, Page 45, Records of Surveys, in the office of the County
Recorder of Orange County, California, more particularly described
as follows:
BEGINNING at the intersection of the centerline of Fairview Road
with the north line of Lot A, Banning Tract, as said intersection
is shown on above-mentioned Record of Survey; thence south
89°54'10" west along said north line of Lot A, Banning Tract, a
distance of 99.85 feet; thence north 00°09'00" east, a distance of
40.00 feet to a point on a line 40.00 feet northerly of, measured ..�
at right angles, and parallel with said north line of Lot A,
Banning Tract, said point also being the TRUE POINT OF BEGINNING;
thence south 89°54'10" west, along last mentioned parallel line, a
distance of 74.00 feet, to a point of cusp with a tangent curve,
concave northwesterly, having a radius of 17.00 feet; thence
northeasterly, along said curve, through a central angle of
90°00'00", an arc distance of 26.70 feet, to a line 57.00 feet
northerly of, measured at right angles and parallel with said north
line of Lot A, Banning Tract; thence north 89°54'10" east, along
last mentioned parallel line, a distance of 40.00 feet, to the
beginning of a curve, concave northeasterly, having a radius of
17.00 feet; thence southeasterly, along said curve, through a
central angle of 90°00'00", an are distance of 26.70 feet to the
TRUE POINT OF BEGINNING.
RESERVING therefrom an easement for all existing underground and
overhead public utilities together with the right of ingress and
egress for the purpose of maintaining, replacing, and upgrading
said existing public utilities.
PASSED AND ADOPTED this 4th day of October, 1976.
