A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO DISPOSE OF SURPLUS REAL PROPERTY; DESCRIBING
THE LAND TO BE SOLD; SETTING FORTH IN GENERAL
TERMS THE INTEREST EASEMENTS OR RESERVATIONS TO
BE RESERVED BY THE PUBLIC, IF ANY; SETTING THE -oft
TIME AND PLACE OF THE SALE; ESTABLISHING TERMS
AND CONDITIONS OF THE SALE AND CALLING FOR
SEALED BIDS IN WRITING.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, Title 1, Division 1, Chapter 1, Article 4.5,
Sections 190 through and including 196 of the Government Code, provides
for a method for the disposition of surplus real property of a local
agency; and
WHEREAS, the City has as surplus lands described on an exhibit
attached to this Resolution marked Exhibit "A" and by this specific
reference made a part hereof; and
WHEREAS, said lands are more particularly described in a plat
marked Exhibit "B" attached to this Resolution and by this specific
reference made a part hereof; and
WHEREAS, City desires to dispose of said lands to the highest
bidder;
NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid
statutory authority, the City does hereby offer for sale the real
property described in Exhibit "A" attached hereto, and as more particu-
larly descriped in the plat marked Exhibit "B" attached hereto.
BE IT FURTHER RESOLVED that said sale shall be in accordance with
the terms and conditions as set forth in the Notice of Sale at Public
Auction attached to this Resolution marked Exhibit "C" and to the
Condition of the Title described in Exhibit "D" both by this specific
reference made a part hereof.
BE IT FURTHER RESOLVED that Notice of Sale be published in the
Orange Coast Daily Pilot once a week for four (4) consecutive weeks,
said notice to be published pursuant to Section 6064 Government Code and
to contain a description of the land or lands to be sold, general terms
including interests or easements or reservations to be reserved by the
City, the time and place of sale, and a call for sealed bids in writing.
BE IT FURTHER RESOLVED that all bids shall be filed with the City
Clerk of the City of Costa Mesa on or before 10:00 a.m. on the kith day
of December, 1976.
BE IT FURTHER RESOLVED that the opening of said bids shall take
place at the hour of 10:00 a.m, in the Council Chambers of the City
Council of the City of Costa Mesa at 77 Fair Drive, Costa Mesa, Cali-
fornia on the 13th day of December, 1976.
BE IT FINALLY RESOLVED that the money derived from said sale be
forthwith paid into the fund from which payment was made for the land.
PASSED AND ADOPTED this 1st day of November, 1976.

NOTICE OF SALE AT PUBLIC AUCTION
WHAT: Public sale of an R-2 zoned parcel of land
containing approximately 8,008 square feet
net, located at the northwesterly corner of
Fullerton Avenue and 20th Street in the
City of Costa Mesa (see map attached marked
EXHIBIT "B"), which is improved with a
three-bedroom, one -bath residence. To be
sold as is.
WHEN:
TERMS:
10:00 a.m., Monday, December 13, 1976.
Minimum Bid: $38,500.00
Bidder's Deposit: A Bidder's Deposit in the amount of $3,850.00
and in the form of a Cashier's Check must be
submitted with the written bid or prior to
oral bidding, if no written bid is submitted.
If your offer is accepted, the Bidder's
Deposit will be applied to the down payment.
Deposits of the unsuccessful bidders will be
refunded.
The Cashier's Check should be made payable
to: City of Costa Mesa.
Down Payment: Twenty percent (20%) of the total amount bid
must be paid within seven days of December 13,
1976, by the bidder who has been notified that
he is the apparent qualified high bidder.
Balance of Payment: The successful bidder will pay the balance of
the purchase price within ninety (90) days
after the City Council executes the sales
contract.
METHODS OF BIDDING:
Where: At the City Council Chambers, 77 Fair Drive,
Costa Mesa, California 92626.
Written Bids: The written bids must be submitted on the
following special forms. No written bids
will be received after 10:00 a.m., Decem-
ber 13, 1976.
Oral Bids: Oral bids will be taken after all written
bids have been opened and read. The first
oral bid must exceed the highest written bid
by at least two percent (2%). No person
will be allowed to participate in oral
bidding unless he has posted the required
Bidder's Deposit. Each successive oral bid
will be in a minimum of $100.00 increments.
