A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF BANNING
PLACE, EAST OF CANYON DRIVE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa does hereby
declare its intention to vacate a portion of Banning Place, described as
follows:
That portion of Banning Place as shown on Tract No. 653 per map
thereof recorded in Book 19, Page 42 of Miscellaneous Maps of
Orange County, California, more particularly described as follows:
BEGINNING at the northeast corner of Lot 70 of said Tract No. 653;
thence north 00°32'00" west along the northerly prolongation of the
westerly line of Canyon Drive a distance of 30.00 feet to the
northerly line of said Tract No. 653; thence south 89928'00" west
along said northerly line a distance of 400.05 feet; thence south
00°32'00" east a distance of 30.00 feet to the northerly line of
Lot 69 of said Tract No. 653; thence north 89°28'00" east along the
northerly line of said Lot 69 and the northerly line of said Lot 70
a distance of 400.05 feet to the POINT OF BEGINNING.
RESERVING therefrom an easement for all existing underground and
overhead public utilities together with the right of ingress and
egress for the purpose of maintaining, replacing, and upgrading
said existing public utilities.
SECTION 2. Monday, the 6th day of December, 1976, at the hour of
6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa
Mesa, California, is hereby fixed as the time and place for hearing all
persons interested in or objecting to the proposed vacation.
SECTION 3. These proceedings shall be conducted pursuant to the
provisions of Section 8300 et seq. of the Streets and Highways Code of
the State of California.
SECTION 4. The City Manager of the City of Costa Mesa is hereby
directed to cause notices of the said proposed vacation to be conspic-
uously posted along said strips of land for at least ten (10) days
before the date of said hearing. Said notices shall be posted not more
than three hundred (300) feet apart, but in no event shall less than
three (3) notices be posted.
SECTION 5. This Resolution shall be published once in the Orange
Coast Daily Pilot, a newspaper of general circulation printed and pub-
lished in the City of Costa Mesa, Orange County, California.
PASSED AND ADOPTED this 15th day of November, 1976.
