Home My WebLink About77-01 - Declaring Wilson Street No. 1 Annexation Annexed to the CityRESOLUTION NO. 77-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING AND ORDERING CERTAIN TERRITORY KNOWN AS WILSON STREET NUMBER ONE ANNEXATION ANNEXED TO THE CITY OF COSTA MESA WITHOUT HEARING OR ELECTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 24th day of November, 1976, approve the annexa- tion of certain territory described as Wilson Street No. 1 Annexation to the City of Costa Mesa, after application having been made for said annexation pursuant to Section 54792, California Government Code, and accompanied by written consent of one hundred percent (100%) of the land owners within the territory. NOW, THEREFORE, the City Council of the City of Costa Mesa, California, finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent (10%) of the number of land owners in the territory proposed to be annexed, owning not more than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexation. (d) That the territory to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city or similar purpose. (e) That the Negative Declaration, completed by the City of Costa Mesa pursuant to the California Environmental Quality Act of 1970, was considered by the Local Agency Formation Commission. The City Council has hereby ordered the annexation of Wilson Street No. 1 Annexation in accordance with Resolution 76-188 of the Local Agency Formation Commission, without notice and hearing and without an election pursuant to Section 54797.1 of the California Government Code. That for taxing purposes said Annexation is to be deemed an annex- ation to the "Basic Area" of the City of Costa Mesa and the Orange County Assessor is so notified. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto marked Exhibit "A" and by this reference made a part hereof. ONE ANNEXATION TO THE CITY OF COSTA MESA All that certain territory situated in the County of Orange, State of California, described as follows: BEGINNING at a point in the existing boundary of the City of Costa Mesa, said point being the northeast corner of said boundary as described in the "Republic No. 3 Annexation" to the City of Costa Mesa, California, Ordinance No. 303; Thence northerly 492.44 feet along the existing boundary of the City of Costa Mesa, said boundary being the westerly boundary as described in the "Republic No. 2 Annexation" to the City of Costa Mesa, California, Ordinance No. 43, through its course in a general northerly direction to the northeast corner of the south half of Lot 138 of Tract No. 653 as shown on a map thereof recorded in Book 19, Page 42, of Miscellaneous Maps, Records of Orange County, State of California; Thence departing from the existing boundary of the City of Costa Mesa south 89°28'00" west, 330.05 feet along the northerly line of said south half of Lot 138 and its westerly prolongation to a point in the center- line of Canyon Drive as shown on said Map of Tract No. 653; Thence south 00°32'00" east, 330.49 feet along the centerline of said Canyon Drive to a point on a tangent curve, concave westerly and having a radius of 318.82 feet; Thence southerly along said curved centerline through a central angle of 24°28'05" an are distance of 136.15 feet to a point in the centerline of Wilson Street as shown on said Map of Tract No. 653; Thence nontangent to said curve north 89°28'00" east, 99.32 feet along the centerline of said Wilson Street to a point in said centerline; Thence south 00°32'00" east, 30.00 feet to a point in the existing boundary of the City of Costa Mesa, said point being the northwest corner of said boundary as described in said "Republic No. 2 Annex- ation"; Thence easterly 259.36 feet along the existing boundary of the City of Costa Mesa, said boundary being the northerly boundary as described in said "Republic No. 2 Annexation", to the POINT OF BEGINNING. The above parcel of land contains 3.7103 acres.
