Home My WebLink About77-02 - Declaring Wilson Street No. 1 Annexation Annexed to the Park and Recreation DistrictRESOLUTION NO. 77-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACTING AS THE EX -OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DISTRICT, DECLARING AND ORDERING CERTAIN TERRITORY KNOWN AS WILSON STREET NUMBER ONE ANNEXATION ANNEXED TO THE COSTA MESA PARK AND RECREATION DISTRICT. THE CITY COUNCIL OF THE CITY OF COSTA MESA, ACTING AS THE EX - OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DIS- TRICT. DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 24th day of November, 1976, approve the annexa- tion of certain territory, described as Wilson Street No. 1 Annexation, to the Costa Mesa Park and Recreation District, after application having been made for said annexation by Mr. J. H. Gregory of Costa Mesa, and accompanied by written consent of one hundred percent (100%) of the land owners within the territory. NOW, THEREFORE, it is hereby found and determined as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent (10%) of the number of land owners in the territory proposed to be annexed, owning not more than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor, in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexation. (d) That the territory to be annexed is contiguous to the existing boundaries of the Costa Mesa Park and Recreation District. (e) That a Negative Declaration, completed by the City of Costa Mesa pursuant to the California Environmental Quality Act of 1970, has been considered by the Local Agency Formation Commission. The City Council has hereby ordered the annexation of Wilson Street No. 1 Annexation in accordance with Resolution 76-187 of the Local Agency Formation Commission. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto marked Exhibit "A" and by this reference made a part hereof. ONE ANNEXATION TO THE COSTA MESA PARK AND RECREATION DISTRICT All that certain territory situated in the County of Orange, State of California, described as follows: BEGINNING at an angle point in the boundary line of "Exclusion No. 3" (River Annexation Area) from the Costa Mesa Park and Recreation Dis- trict, adopted by the Orange County Board of Supervisors - December 20, 1961, said angle point also being the northeast corner of "Republic No. 3 Annexation" to the City of Costa Mesa; Thence north 00°32'00" west, 492.44 feet along the easterly boundary line of said "Exclusion No. 3" and along the westerly boundary line of "Republic No. 2 Annexation" to said City of Costa Mesa to the northeast corner of the south half of Lot 138 of Tract No. 653 as shown on a map recorded in Book 19, Page 42, of Miscellaneous Maps, Records of said Orange County; Thence leaving the existing boundary line of said City of Costa Mesa and the Costa Mesa Park and Recreation District, south 89°28'00" west, 330.05 feet along the northerly line of said south half of Lot 138 and its westerly prolongation to a point in the centerline of Canyon Drive as shown on said map of Tract No. 653 and an angle point in the existing boundary line of said Costa Mesa Park and Recreation District, per "Canyon Drive Annexation No. 2"; Thence leaving said existing boundary line south 00°32'00" east, 330.49 feet along said centerline to a point on a tangent curve, concave westerly and having a radius of 318.82 feet; Thence southerly along said curve and centerline through a central angle of 24°28'05" an arc distance of 136.15 feet to the centerline of Wilson Street; Thence nontangent to said curve and along said centerline of Wilson Street north 89°28'00" east, 99.32 feet more or less, to a point north 00°32'00" west, from the northwest corner of said "Republic No. 2 Annexation"; Thence south 00°32'00" east, 30.00 feet to said northwest corner of "Republic No. 2 Annexation" and a point in the boundary line of said Costa Mesa Park and Recreation District per "Exclusion No. 3"; Thence north 89°28'00" east, 259.36 feet along the existing boundary line of said City of Costa Mesa per "Republic No. 3 Annexation" and along said boundary line of "Exclusion No. 3" from the Costa Mesa Park and Recreation District to the POINT OF BEGINNING. The above parcel of land contains 3.713 acres.
