HomeMy WebLinkAbout77-68 - Abandoning Condemnation of Warwick ParcelsRESOLUTION NO. 77-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ABANDONING CONDEMNATION OF THE WARWICK PARCELS AND AUTHORIZING THE CITY ATTORNEY'S OFFICE TO TAKE SUCH STEPS AS ARE NECESSARY TO ACCOMPLISH SAME. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa by Resolution No. 75-98, adopted on September 16, 1975, authorized the acquisition of that portion of Lot 20 of Fairview Farms per map recorded in Book 8, Page 71 of Miscellaneous Maps, records of Orange County, belonging to Delbert L. and Mary Jane Warwick for a westside park site; and WHEREAS,- the City Council of the City of Costa Mesa was at the time of the adoption of Resolution No. 75-98 unaware of the availability of the Canyons Park property as a suitable park site, and was likewise unaware of the existence of cooperative State funding which would have been available for the purchase of said park site; and WHEREAS, on March 21, 1977, subsequent to the adoption of said Resolution No. 75-98, the City Council of the City of Costa Mesa author- ized the City Manager to enter into an agreement for the purchase of the Canyons Park property; and WHEREAS, the addition of the Canyons Park property, consisting of approximately 35 acres, brings the existing westside open space into conformance with that envisioned under the City's General Plan; and WHEREAS, the City Council hereby finds that it is in the public interest and necessity that the Warwick parcels not be acquired at this time for park purposes; and WHEREAS, if said acquisition were completed as planned, the result would be a surplus of park property on the westside of the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED that the proposed acquisition of the Warwick parcels be abandoned in accordance with applicable statutory provisions. BE IT FURTHER RESOLVED that the City shall reimburse the property owners for costs incurred to date in defending against the City's condemnation action as may be required by law. BE IT FINALLY RESOLVED that the City Attorney's Office be author- ized to approve such reimbursement for costs in accordance with the authorization contained in this Resolution and applicable law.
