HomeMy WebLinkAbout77-86 - Fees for Duplicating City RecordsRESOLUTION NO. 77-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, SETTING FORTH PROCEDURES AND FEES FOR THE INSPECTION AND DUPLICATION OF CITY RECORDS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, the City Council of the City of Costa Mesa has adopted Ordinance No. 77-34 (codified as CMMC Section 2-245) incor- porating the California Public Records Act; and WHEREAS, pursuant to said Ordinance and Act, certain guidelines and fee schedules as determined by a time study are necessary and are hereby established for the general health, safety, and welfare of the public; NOW, THEREFORE, BE IT RESOLVED that the following rules, proce- dures, and fee schedules are hereby adopted for the inspection or duplication of City records: 1. INSPECTION PROCEDURES Subject to the exemptions set forth in the California Public Records Act (Government Code Section 6250 et seq.) records of every department of the City shall be open to inspection by members of the public as follows: (a) NORMAL OFFICE HOURS: Persons may request inspection or duplication of City records during the normal working hours of the day. (b) MAIL OR PHONE REQUEST: Persons may request copies of City records by mail or phone provided they sufficiently identify the records and pay the fees or deposit for fees required. (c) EXCEPTIONAL REQUEST: Due to emergency or other exceptional circumstances, the foregoing time limitations may be waived by the Department Head, or his designee, whose records are requested. 2. FEE SCHEDULE Fees for duplicating City records, not exempt from disclosure, reflect the costs of the time required for retrieval, reproduction, and processing of such requests. Said fees are established as follows: (a) First Page duplicating $2.00; (b) Subsequent pages at $ .10 per page plus extraordi- nary time, if any; (c) Additional actual costs may be involved based upon the time and number of records involved; (d) Where transcripts of recorded hearings are requested, an estimate of fees due for providing same shall be determined and a deposit for fees paid in said amount before such tran- scripts are processed. Refunds, additional sums, or actual costs in processing same, shall be due prior to receipt of such transcripts. 3. This Resolution shall be posted in a conspicuous place in the various City facilities and copies may be provided free of charge to persons requesting same.
