HomeMy WebLinkAbout77-90 - Ordering Vacation of Londonderry and Cork LaneRESOLUTION NO. 77-90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE VACATION OF A PORTION OF LONDONDERRY STREET AND CORK LANE, IN TRACT 4356. WHEREAS, the City Council of the City of Costa Mesa did, on the 20th day of June, 1977, pass and adopt Resolution No. 77-76, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF LONDON- DERRY STREET AND CORK LANE, IN TRACT 4356; and WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 18th day of July, 1977, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Section 8300 et seq, of the Streets and Highways Code of the State of Cali- fornia; and WHEREAS, said date of hearing coming on regularly to be heard, all persons appearing on the proposed vacation were heard, and said hearing was closed on the 18th day of July, 1977; and WHEREAS, the City Council of the City of Costa Mesa finds and determines, from all the evidence submitted, that the hereinafter described right-of-way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described right-of-way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right-of-way be, and the same is hereby, vacated: A strip of land, 5.00 feet in width, being a portion of Londonderry Street and Cork Lane, as shown on a map of Tract No. 4356, recorded in Book 168, Pages 34-36 of Miscellaneous Maps, records of Orange County, California, the most southerly, southwesterly, and westerly line of which is described as follows: BEGINNING at the northwest corner of Lot 71 of said Tract No. 4356; thence north 89'24'15" east along the north line of said Lot 71 a distance of 85.00 feet to the beginning of a tangent curve, concave southwesterly, having a radius of 15.00 feet; thence southeasterly along said curve through a central angle of 90°00'00" an arc distance of 23.56 feet; thence south 0°35'45" east a distance of 50.00 feet to the southeast corner of said Lot 71. RESERVING therefrom an easement for public utility purposes over, under, across, and through the most northerly, northeasterly, and easterly 3.00 feet of the above described 5.00 -foot wide strip of land. RESERVING therefrom an easement for all existing underground and overhead public utilities together with the right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities.
