HomeMy WebLinkAbout78-50 - Intention to Form Landscaping District No. 1RESOLUTION NO. 78-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE FORMATION OF CITY OF COSTA MESA LANDSCAPING ASSESSMENT DISTRICT NUMBER 1 AND GIVING NOTICE OF A TIME AND PLACE FOR A PUBLIC HEARING ON SAID FORMATION AND THE LEVY OF AN -� ASSESSMENT ON SAID DISTRICT. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, City Council approval of Tentative Tract 9901 of June 20, 1977, contained a condition which states, "Landscaped setbacks and parkways along Sunflower Avenue and Smalley Road shall be maintained by a mandatory homeowners' association or by establishment of an assess- ment district under the Landscaping and Lighting Act of 1972"; and WHEREAS, this Council did adopt Resolution 77-95 proposing the formation of City of Costa Mesa Landscape Assessment District Number 1 and directing the City Engineer to prepare a report with respect to said district pursuant to Section 22565 through and including Section 22574 of the Streets and Highways Code of the State of California; and WHEREAS, the City Engineer has prepared the above mentioned report and filed it with the City Council; and WHEREAS, this Council has approved said report as filed; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby find, determine, and resolve as follows: 1. The City Council hereby declares its intention to order the formation of an assessment district, known as the City of Costa Mesa Landscaping Assessment District Number 1, an area encompassed by Tract Number 9901 and more particularly described in Exhibit A attached hereto and incorporated herein by reference, and to levy and collect assessments pursuant to Part 2, Division 15 of the Streets and Highways Code of the State of California. 2. A general description of the improvements relevant to said district is as follows: The maintenance and possible future replacement of landscaping and any facilities which are appurtenant thereto, or which are necessary or convenient for the maintenance or possible future replacement thereof, including the removal of debris, clearing, the maintenance and repair of water irrigation or drainage facilities on lettered lots B and C of Tract 9901. 3. Reference is hereby made to the report of the City Engineer relating to the said district. Said report is on file with the City Clerk of the City of Costa Mesa and contains a full detailed description of the improvements, the boundaries of the proposed assessment district, and contains the proposed assessment upon assessable lots and parcels of land within City of Costa Mesa Landscaping Assessment District Number 1. Said report is attached hereto as Exhibit A and incorporated herein by reference. 4. This Council hereby fixes 6:30 p.m., or as soon as possible thereafter, on May 15, 1978, at the Costa Mesa City Council Cham- bers, 77 Fair Drive, Costa Mesa, California, as the time and place for a hearing before this Council on the question of formation of City of Costa Mesa Landscaping Assessment District Number 1 and the levy of the proposed assessment thereon, and hereby gives notice of said hearing. 5. The City Clerk shall certify to the adoption of this Resolu- tion and shall cause a true and correct copy of this Resolution to be mailed by First Class Mail, postage prepaid, to owners of real property located within the proposed assessment district at the address or addresses indicated on the last equalized assessment roll of Orange County or the State Board of Equalization Assessment Roll at least ten (10) days prior to May 15, 1978. SECTION II RArWrROTiNn This Landscaping Assessment District is being formed as a result of Specific Plan SP -76-03. This Specific Plan set as a development standard for the area in question that a "private mandatory homeowner's associa- tion or landscape assessment district must be established", and that "such an association or assessment district shall be responsible for the maintenance of the required setbacks along Smalley Road and Sunflower Avenue". SECTION III DESCRIPTION A. General A diagram of the City of Costa Mesa Landscaping Assessment District No. 1 is included herein. The District is located on the southeast corner of Sunflower Avenue and Smalley Road. The lands within the District are designated as Tract 9901 which has received approval of the Planning Commission and the City Council of the City of Costa Mesa. B. Plans and_5pecifications Plans and Specifications for the improvement of this project are on file in the office of the Planning Department. These plans include the installation of landscaping and an irrigation system as required by the City's conditions for development. The plans and specifications are hereby incorporated into this report by reference. C. Estimate of the Costs of the Improvements No improvement costs will be assessed against the lands within the District. All such improvements are contributed to the District as a condition of development for Tract 9901. Maintenance costs are dis- cussed in Section IV B. of this report. D. Assessment Diasram A diagram of the Assessment District entitled "City of Costa Mesa Landscaping Assessment District No. 1" in the City of Costa Mesa, County of Orange, State of California, is included herein as Appendix B and C. Assessment Parcels 1 through 50 being also Lots 1 through 50 of Tract 9901 in the City of Costa Mesa, County of Orange. CFP TTnM TV ASSESSMENT A. General The assessment costs contained herein are for maintenance only. The costs of improvements, as previously stated, will be contributed by the developer of Tract 9901 with no costs of such improvements assessed against the lands. B. Therefore, no zones of benefit have been established, and all parcels will share equally in the assessment for maintenance.
