HomeMy WebLinkAbout78-58 - Ordering Sunset Bluffs Annexation to the CityRESOLUTION NO. 78-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING AND ORDERING CERTAIN TERRITORY KNOWN AS SUNSET BLUFFS ANNEX- ATION ANNEXED TO THE CITY OF COSTA MESA WITHOUT HEARING OR ELECTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 10th day of May, 1978, approve the annexation of certain territory described as Sunset Bluffs Annexation to the City of Costa Mesa, after application having been made for said annexation pursuant to Section 54792, California Government Code, and accompanied by written consent of one hundred percent (100%) of the land owners within the territory; NOW, THEREFORE, the City Council of the City of Costa Mesa, Cali- fornia, finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited and no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent (10%) of the number of land owners in the territory proposed to be annexed, owning not more than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexa- tion. (d) That the territory to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city or similar purpose. (e) That the Negative Declaration issued by the Executive Officer of the Orange Councy Local Agency Formation Commission, pur- suant to the California Environmental Quality Act of 1970, was considered and adopted by the Local Agency Formation Commis- sion on May 10, 1978, by Resolution 78-98. (f) That the Final Environmental Impact Report in connection with The Janes Company Bluffs Development was accepted by the Costa Mesa City Council on November 19, 1974. The City Council has hereby ordered the annexation of Sunset Bluffs Annexation in accordance with Resolution 7898 of the Local Agency Forma- tion Commission, without notice and hearing and without an election, pursuant to Section 54797.1 of the California Government Code. That for taxing purposes, said Annexation is to be deemed an annexation to the "Basic Area" of the City of Costa Mesa and the Orange County Assessor is so notified. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto, marked Exhibit "A", and by this reference made a part hereof. City Clerk and ex -officio Clerk the City Council of the City of Co Mesa SUNSET BLUFFS ANNEXATION TO THE CITY OF COSTA MESA That portion of Tract No. 653 as shown on a map recorded in Book 19, Page 42 of Miscellaneous Maps, Records of Orange County, California, more particularly described as follows: BEGINNING at an angle point in the existing boundary line of the City of Costa Mesa, said point being the northeasterly corner of the "Vista Annexation" and a point in the easterly prolongation of the southerly line of Lot 34 of said Tract No. 653; Thence along the northerly line of said annexation and along said easterly prolongation and southerly line of said Lot 34, north 84°22'20" west, 595.60 feet to an angle point in said existing boundary line, said angle point being the southwest corner of said Lot 34; Thence leaving said existing boundary line as created by said "Vista Annexation" and along the northwesterly line of said Lot 34 to and along said existing boundary line as created by the "River No. 3 Annexation" north 36°46'30" east, 191.00 feet to the most northerly corner of said Lot 34; Thence leaving said existing boundary line as created by said "River No. 3 Annexation" and along the northerly line of said Lot 34 and its easterly prolongation south 72°54'40" east, 514.93 feet to a point on a nontangent curve in the centerline of Pacific Avenue concave easterly and having a radius of 300.00 feet, a radial line to said point bears north 72°59'12" west; Thence southerly along said curve and centerline through a central angle of I1°27'33" an arc distance of 60.00 feet to the POINT OF BEGINNING. The above parcel of land contains 1.48 acres, more or less.
