HomeMy WebLinkAbout78-61 - Approving Orange County Safer Off-System Roads ProgramRESOLUTION NO. 78-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE ORANGE COUNTY SAFER OFF -SYSTEM ROADS PROGRAM AND THE METHOD OF DISTRIBUTION OF FUNDS. On motion of Councilwoman Schafer, duly seconded and carried, the following Resolution was adopted: WHEREAS, in accordance with Section 219 of Title 23, United States Code (Safer Off -System Roads), and Section 2520 et seq., Chapter 12, of the California Streets and Highways Code, certain Federal funds will become available to Orange County for expenditure for safety improve- ments on roads not on a Federal system within the County and the cities; and WHEREAS, Section 2530, Chapter 12, of the Streets and Highways Code specifies that the funds are to be apportioned to the County and County shall enter into agreement with the cities in the County con- cerning the distribution of the funds among the cities and the County, said agreement to be placed on file with the California Department of Transportation (CALTRANS); NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa, State of California, hereby agrees as follows: 1. That any Federal funds that may become available to Orange County for the Safer Off -System Roads Program as described in Section 219 of Title 23, United States Code, shall be dis- tributed among the cities and the County based on the alloca- tion formula of a base amount of $2,500.00 to each eligible agency, the remaining funds allocated on the ration of the population of each agency to the total County population. 2. That eligibility for particpation shall be based on the agreement of the distribution of the funds described herein. 3. The population figures to be used shall be those based on the most recent Countywide census or as may be determined by the Board of Supervisors. 4. If any of the local agencies decide not to participate in this program for any of the following reasons, agency and its population shall automatically be excluded from the computa- tions for distribution: a. Failure to agree on distribution of funds. b. Failure to claim funds in time specified. C. Failure to submit plans, specifications, and estimate of costs to the California Department of Transportation by September 15, of the Federal Fiscal Year in which the funds expire. 5. By mutual agreement and with the approval of the California Department of Transportation, the apportionment formula of Safer Off -System Road Funds may be changed to any other. formula. 6. Each agency shall be responsible for the compliance with the California Environmental Quality Act or the National Environ- mental Policy Act, whichever is applicable. 7. Each agency shall act independently in processing projects under the Safer Off -System Roads Program and in applying for reimbursement of Federal funds. B. Each agency shall inform the Technical Staff of the County's Arterial Highway Financing Program (AHFP) of the status and progress of their projects on a semi-annual basis or as may be required to insure progress of the Safer Off -System Roads Program in Orange County.
