78-88 - Bristol/Red Hill Annexation to City without Election
RESOLUTION NO. 78-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING AND ORDERING CERTAIN TERRITORY KNOWN AS BRISTOL/RED HILL ANNEXATION ANNEXED TO THE CITY OF COSTA MESA WITHOUT HEARING OR ELECTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 12th day of April, 1978, approve the annexation of certain territory described as Bristol/Red Hill Annexation to the City of Costa Mesa, after application having been made for said annex- ation pursuant to Section 54792, California Government Code, and ac- companied by written consent of one hundred percent (100%) of the land owners within the territory; NOW, THEREFORE, the City Council of the City of Costa Mesa, Cali- fornia, finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will he for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexation. (d) That the territory to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city or similar purpose. (e) That the Negative Declaration issued by the Executive Officer of the Orange County Local Agency Formation Commission, pursuant to the California Environmental Quality Act of 1970, was reviewed and considered by the Local Agency Formation Commission on April 12, 1978, by Resolution 78-81. The City Council has hereby ordered the annexation of Bristol/ Red Hill Annexation in accordance with Resolution 78-81 of the Local Agency Formation Commission, without notice and hearing and without an election, pursuant to Section 54797.1 of the California Government Code. That for taxing purposes, said Annexation is to be deemed an annex- ation to the "Basic Area" of the City of Costa Mesa and the Orange County Assessor is so notified. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto, marked Exhibit "A", and by this reference made a part hereof. Cit Clerk and ex -officio Clerk of e City Council of the City of Costa sa BRISTOL/RED HILL ANNEXATION TO THE CITY OF COSTA MESA All that certain land situated in the County of Orange, State of California, more particularly described as follows: BEGINNING at an angle point in the existing boundary line of the City of Costa Mesa, said point being at the southeasterly terminus of that line described as "north 49°22'03" west, 1,320.71 feet" in the Red Hill Annexation No. 1 to the City of Costa Mesa, adopted by the City Council by Resolution No. 76-25, said line also being the centerline of Bristol Street (formerly Palisades Road); thence, leaving said boundary of the City of Costa Mesa, southeasterly, along the prolongation of said boundary, south 49°22'03" east, 89.89 feet to the intersection with a line parallel with and 900.00 feet northwesterly, measured at right angles, from the northwesterly line of Tract No. 706, as shown on a map recorded in Book 21, Page 25 of Miscellaneous Maps, Records of said Orange County, California; thence south 40°37'57" west 319.65 feet, along said parallel line to the easterly line of Tract No. 456, recorded in Book 17, Page 9 of Miscellaneous Maps, Records of said Orange County, California; thence along the boundary line of said Tract No. 456 through the following courses: north 49°39'33" west, 229.88 feet; thence north 67°39'33" west 81.00 feet; thence north 82°39'33" west 145.15 feet; thence north 51°59'33" west 183.60 feet; thence north 60°59'33" west 87.00 feet; thence north 71059'33" west 77.00 feet; thence north 86°49'33" west 232.00 feet; thence north 40°02'58" west 464.61 feet to the southwesterly prolongation of that certain course described as "south 40°37'52" west 462.13 feet" in the boundary line of Country Club No. 2 Annexation to the City of Costa Mesa, adopted by the City Council by Resolution No. 68-58, said line also being the center- line of Santa Ana Avenue; thence northeasterly, along said prolongation north 40°37'03" east, 85.22 feet to said southwesterly terminus of that certain course described as "south 40°37'52" west, 462.13 feet"; thence continuing north 40°37'03" east, along said boundary line, 4.93 feet to the most westerly corner of that certain land described in the deed to Walter R. Schmid and Margaret K. Schmid, recorded March 22, 1965, in Book 7453, Page 681 of Official Records of said Orange County, thence, leaving said last mentioned boundary, south 39°42'58" east 152.16 feet, along the southwesterly line of said Schmid land to the most southerly corner thereof; thence north 40°37'03" east 482.71 feet, along the southeasterly line of said Schmid land and the northeasterly prolonga- tion thereof, to a point in the existing boundary line of the City of Costa Mesa, per said Red Hill Annexation No. 1, said point being within said line described as "north 49°22'03" west, 1,320.71 feet"; thence southeasterly, along said boundary line south 49°22'03" east, 1,170.71 feet to the POINT OF BEGINNING.
