HomeMy WebLinkAbout77-123 - Accepting Continuous Offer to Dedicate on Superior Avenue - KayRESOLUTION NO. 77-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACCEPTING A CONTINUOUS OFFER TO DEDICATE CERTAIN REAL PROPERTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: THAT, WHEREAS, Michael D. Kay and Vivian M. Kay, husband and wife, were the holders in joint tenancy of the following described real property: The northwesterly 420.00 feet of Lot 31 of Newport Heights, as shown on a map recorded in Book 4, Page 83 of Miscellaneous Maps, records of Orange County, California, except therefrom the north- easterly 220.00 feet thereof. The portion to be dedicated is more particularly described as follows: All that land lying within a strip of land measured 50.00 feet southerly from the centerline of Superior Avenue. WHEREAS, on May 14, 1973, Michael and Vivian Kay executed before W. Barry Persel, a Notary Public, a Continuous Offer to Dedicate the above described real property to the City of Costa Mesa for street purposes, which offer was duly recorded in Book 10737, Page 803 of the Official Records of the County of Orange, State of California, on June 7, 1973; and WHEREAS, the City of Costa Mesa has now determined that a compre- hensive program of street widening of Superior Avenue from 17th Street southeasterly to Industrial Way shall begin with right-of-way acquisi- tion in the fall of 1977, and with actual construction to commence in 1978, and that said project shall require the acquisition of the above described real property; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa herewith accepts the real property within the above mentioned Offer to Dedicate, described as follows: The northwesterly 20.00 feet of Lot 31 of Newport Heights, as shown on a map recorded in Book 4, Page 83 of Miscellaneous Maps, records of Orange County California, excepting therefrom the northeasterly 220.00 feet thereof. For the purpose of this description, it is intended that the northwesterly line of said Lot 31 is parallel and 30.00 feet southeasterly of the centerline of Superior Avenue. All as more particularly shown on Exhibit "A" attached hereto and made a part hereof. BE IT FURTHER RESOLVED that upon adoption of this Resolution, the City Clerk shall record same in the Official Records of the County of Orange, State of California, and shall mail a true and certified copy thereof by certified mail to the fee owners of the real property herein described.
