HomeMy WebLinkAbout77-154 - Ordering Pacific Vista Annexation Territory Annexed to the Costa Mesa Park & Recreation DistrictRESOLUTION NO. 77-154 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACTING AS THE EX -OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DISTRICT, DECLARING AND ORDERING CER- TAIN TERRITORY KNOWN AS PACIFIC VISTA ANNEXATION ANNEXED TO THE COSTA MESA PARK AND RECREATION DISTRICT. THE CITY COUNCIL OF THE CITY OF COSTA MESA, ACTING AS THE EX - OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DISTRICT, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 9th day of November, 1977, approve the annexation of certain territory described as Pacific Vista Annexation to the Costa Mesa Park and Recreation District, after application having been made for said annexation pursuant to Section 54792, California Government Code, and accompanied by written consent of one hundred percent (100%) of the land owners within the territory; NOW, THEREFORE, it is hereby found and determined as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent (10%) of the number of land owners in the territory proposed to be annexed, owning not more than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annex- ation. (d) That the territory to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city or similar purpose. (e) That the Negative Declaration, completed by the City of Costa Mesa, pursuant to the California Environmental Quality Act of 1970, was considered and adopted by the City Council in connection with Prezone R-77-36 on December 5, 1977. The City Council has hereby ordered the annexation of Pacific Vista Annexation in accordance with Resolution 77-166 of the Local Agency Formation Commission, without notice and hearing and without an elec- tion, pursuant to Section 54797.1 of the California Government Code. That for taxing purposes, said Annexation is to be deemed an annexation to the "Basic Area" of the City of Costa Mesa and the Orange County Assessor is so notified. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto, marked Exhibit "A", and by this reference made a part hereof.
