A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND
UTILITY DISTRICT NUMBER TWELVE ON BAKER STREET
FROM THE EAST SIDE OF THE CORONA DEL MAR FREE-
WAY TO 350 FEET WEST OF THE NORTHERLY EXTENSION
OF BABB STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, a public hearing was called for January 2, 1979, at
the hour of 6:30 p.m., in the Council Chambers of City Hall, Costa
Mesa, California, to ascertain whether the public necessity, health,
or welfare require the underground installation of wires and facili-
ties for supplying electrical, communication, or similar or associ-
ated service, within that certain area of Costa Mesa described as
follows:
A strip of land 150.00 feet in width, lying 75 feet on each side
of the following described line:
BEGINNING at the intersection of the centerline of Baker Street
with the east side of the Corona del Mar Freeway, then pro-
ceeding west along the centerline of Baker Street to 350.00 feet
west of the northerly extension of Babb Street.
All as more particularly shown on the map attached hereto and
made a part hereof; and
WHEREAS,

WHEREAS, such hearing has been duly and regularly held and all
persons interested have been given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Costa Mesa, that pursuant to Title 13, Chapter VIII, Sections 13-
684 through 13-700, Costa Mesa Municipal Code, the above described
area is hereby declared an Underground Utility District and is
designated as Underground Utility District No. 12 of the City of
Costa Mesa. Attached hereto marked Exhibit "A" and hereby incor-
porated as a part of this Resolution, is a map delineating the
boundaries of said District.
BE IT FURTHER RESOLVED that the Council does hereby fix Septem-
ber 1, 1979, as the date on which affected property owners must be
ready to receive underground service, and does hereby order the
removal of all poles, overhead wires, and associated overhead struc-
tures, and the underground installation of wires and facilities for
supplying electrical, communication, or similar or associated service
within Underground Utility District No. 12 in September, 1979.
BE IT FURTHER RESOLVED that the following exceptions in said
Underground Utility District No. 12 be, and they are hereby author-
ized-
(1)

(1) Any Municipal facilities or equipment installed under the
supervision and to the satisfaction of the City Engineer.
(2) Poles or electroliers used exclusively for street lighting
(or traffic signals).
(3) Overhead wires (exclusive of supporting structures) crossing
any portion of a District within which overhead wires have
been prohibited, or connecting to building on the perimeter
of a District, when such wires originate in an area from which
poles, overhead wires, and associated overhead structures are
not prohibited.
(4) Poles, overhead wires, and associated overhead structures used
for the transmission of electric energy at nominal voltages in
excess of 34,500 volts. •-�.
(5) Antennae, associated equipment, and supporting structures,
used by a utility for furnishing communication services.
(6) Equipment appurtenant to underground facilities such as
surface -mounted transformers, pedestal -mounted terminal boxes
and meter cabinets, and concealed ducts.
(7) Temporary poles, overhead wires, and associated overhead
structures used or to be used in conjunction with construction
projects.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property
within Underground Utility District No. 12 of the adoption of this Reso-
lution within ten (10) days after the date of such adoption. Said City
Clerk shall further notify said property owners of the necessity that,
if they or any person occupying such property desires to continue to
receive electric, communication, or other similar or associated service,
they or such occupant shall, by the date fixed in this Resolution,
provide all necessary facility changes on their premises so as to
receive such from the lines of the supplying utility or utilities at a
new location, subject to applicable rules, regulations, and tariffs of
the respective utility or utilities on file with the Public Utilities
Commission of the State of California. Such notification shall be made '~
by mailing a copy of this Resolution, together with a copy of said
Sections 13-684 through 13-700 of the Costa Mesa Municipal Code, to all
affected property owners as such are shown on the last equalized assess-
ment roll and to the affected utilities.
BE IT FINALLY RESOLVED that the City Council hereby finds and
determines as follows:
(1) The undergrounding will avoid or eliminate an unusually
heavy concentration of overhead distribution facilities.
(2) The streets and rights of way in the District are exten-
sively used by the general public and carry a heavy volume
of pedestrian and vehicular traffic.
