A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, COMMITTING TO THE IMPLE-
MENTATION AND ENFORCEMENT OF THOSE ELEMENTS OF
THE SOUTH COAST AREA WIDE WASTE TREATMENT MANAGE-
MENT PLAN APPROPRIATE TO ITS JURISDICTION.
WHEREAS, the Federal Water Pollution Control Act, 33 USC 1251, et
seq. as amended, seeks to develop a cooperative Federal, State, Regional
and Local Government Program to prevent and control sources of pollution
to ground and surface waters in order to restore and maintain the chemi-
cal, physical, and biological integrity of the Nation's waters; and
WHEREAS, pursuant to Section 208 of the Federal Water Pollution
Control Act of 1972, as amended, the Southern California Association of
Governments, herein referred to as SCAG, has prepared an Area Wide Waste
Treatment Management Plan for the South Coast Area with the assistance
of the Counties of Los Angeles, Orange, Riverside, and San Bernardino,
the City of Los Angeles, the Newport -Irvine Waste Management Planning
Agency, the Santa Ana Water Project Authority, and the Ventura Regional
County Sanitation District; and
WHEREAS, the Area Wide Waste Treatment Management Plan for the
South Coast Area will be adopted by SCAG on April 5, 1979, and forwarded
to the State Water Resources Control Board for certification and there-
after will be forwarded to the Federal Environmental Protection Agency
in compliance with Section 208 (b) (3), of the Federal Water Pollution
Control Act of 1972, as amended; and
WHEREAS, the Area Wide Waste Treatment Management Plan for the
South Coast Area proposes management agencies to be responsible for Plan
implementation and pursuant to publish United States Environmental
Protection Agency guidelines, (42 Federal Register 44777 1977) must
indicate each management agency's willingness to proceed to carry out
its responsibilities as identified in the Plan; and
WHEREAS, the City Council of the City of Costa Mesa is assigned
certain responsibilities in the Area Wide Waste Treatment Management
Plan for the South Coast Area, approved by the SCAG Executive Committee
on February 1, 1977;
NOW, THEREFORE, be it resolved that it is the intent of the City
Council of the City of Costa Mesa, to procded with implementation of its
responsibilities as set forth in the 208 Area Wide Waste Treatment
Management Plan as approved by SCAG, said responsibilities specifically
described and amended as follows:
1. Maintain existing street sweeping programs (prior to Proposi-
tion 13) with consideration given to increasing their effec-
tiveness in reducing waste loads to receiving waters to the
extent financially feasible;
2. Maintain current litter control programs to the extent fin-
ancially feasible;
3. Maintain current catch basin and storm drain cleaning programs
with consideration given to increasing program effectiveness
to the extent financially feasible;
4. By October, 1979, develop, adopt, and enforce a grading and
erosion control ordinance. This ordinance may include ele-
ments included in the SCAG Model Grading Ordinance as proposed
in the 208 Area Wide Waste Treatment Management Plan. Imple-
mentation of the Ordinance shall be on a project to project
basis taking into consideration the required Environment
Impact Report and staff recommendations;
5. Require corrective maintenance activities for existing road-
ways, including utility Rights of Way and other access roads
where erosion controls are proven necessary and financially
feasible;
6. Within eight years after specific 208 guidelines are estab-
lished, develop and implement an optimum mix of street sweep-
ing equipment to the extent financially feasible;
7. By April, 1979, modify street sweeping practices to improve
the quality of urban run-off;
8. Improve streets with curbs and gutters where needed to facil-
itate removal of significant street pollutants as a condition
of development.
BE IT FINALLY RESOLVED that copies of this Resolution be forwarded
to the SCAG Executive Committee and to the Board of Directors of the
Newport -Irvine Waste Managment Treatment Agency.
