HomeMy WebLinkAbout79-65 - Setting Public Hearing for Formation of Landscaping District 2RESOLUTION NO. 79-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE FORMATION OF CITY OF COSTA MESA LANDSCAPING ASSESSMENT DISTRICT NO. 2, AND GIVING NOTICE OF A TIME AND PLACE FOR A PUBLIC HEARING ON SAID FORMATION, AND THE LEVY OF AN ASSESSMENT ON SAID DISTRICT. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, Planning Commission approval of Tentative Tract 10513 on August 28, 1978, contained a condition which states, in part, "Landscaped setbacks (Lots A, B, and C), parkways along Yukon Avenue and Bear Street, and the park access walk shall be maintained by the establishment of an Assessment Distict under the Landscaping and Lighting Act of 1972"; and WHEREAS, this Council did adopt Resolution 79-7 proposing the formation of the City of Costa Mesa Landscaping Assessment District No. 2, and directing the City Engineer to prepare a report with respect to said District pursuant to Section 22565 through and including Section 22574 of the Streets and Highways Code of the State of California; and WHEREAS, the City Engineer has prepared the above-mentioned report and filed it with the City Council; and WHEREAS, this Council has approved said report as filed; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby find, determine and resolve as follows: 1. The City Council hereby declares its intention to order the formation of an Assessment District, known as the City of Costa Mesa Landscaping Assessment District No. 2, an area encompassed by Tentative Tract 10513 and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, and to levy and collect assessments pursuant to Part 2, Division 15, of the Streets and Highways Code of the State of California. 2. A general description of the improvements relevant to said District is as follows: The maintenance and possible future replacement of landscaping and any facilities which are appurtenant thereto, or which are necessary or convenient for the maintenance or possible future replacement thereof, including the removal of debris and maintenance and repair of water irrigation or drainage facilities within the parkways adjacent to Bear Street and Yukon Avenue, and lots A, B, C, and D of Tract 10513. 3. Reference is hereby made to the Report of the City Engineer relating to the said District. Said report is on file with the City Clerk of the City of Costa Mesa and contains a full and detailed description of the improvements, the boundaries of the proposed Assessment District, and contains the proposed assessment upon assessable lots and parcels of land within the City of Costa Mesa Landscaping Assessment District No. 2. Said report is attached hereto as Exhibit "A" and incorporated herein by reference. 4. This Council hereby fixes 6:30 p.m., or as soon as possible thereafter on June 18, 1979, at the Costa Mesa City Council Chambers, 77 Fair Drive, Costa Mesa, California, as the time and place for a hearing before this Council on the 1!jh question of formation of the City of Costa Mesa Landscaping Assessment District No. 2, and the levy of the proposed assessment thereon, and hereby gives notice of said hearing. 5. The City Clerk shall certify to the adoption of this Resolution and shall cause a true and correct copy of this Resolution to be published, posted and mailed as required by Sections 22552 through and including 22557 of the Streets and Highways Code of the State of California. SFXTICN II BACKGROUND This Landscaping Assessment District is being formed to provide for the continued maintenance of Landscaping which is being installed on Lots A, B, C and D as a City condition of development for Tract 10513. SECTION III DESCRIPTION A. General A diagram of the City of Costa Mesa Landscaping Assessment District No. 2 is included herein. The District is located on the northwest corner of Bear St. and the Corona Del Mar Freeway. The lands within the District are designated as Tract 10513, which has received approval of the Planning Com- mission and the City Council of the City of Costa Mesa. B. Plans and Specifications Plans and Specifications for the improvement of this project are on file in the office of the Planning 6 Development Services Department. These plans include the installation of landscaping and an irrigation system as required by the City's conditions for developrent. The plans and specifications are here- by incorporated into this report by reference. C. Estimate of the Costs of the Improvements No improvement costs will be assessed against the lards withing the District. All such inprovements are oontfibuted to the District as a condition of develop- ment for Tract 10513. Maintenance costs are discussed in Section IV B. of this report. D. Assessment Diagram A diagram of the Assessment District entitled 'City of Costa Mesa land- scaping Assessment District No. 2' in the City of Costa Mesa, County of Orange, State of California, is included herein as Appendix B. Lines and Dimensions The boundaries of the District are described as being all of Tract 10513 City of Costa Mesa, County of Orange, as per map recorded in Book 448, page 45 of Miscellaneous Maps in the office of the County rdecorder of Orange County, State of California. Lots 1 through 41 of Tract No. 10513 in the City of Costa Mesa, County of Orange. SECTION N ASSESSMENT A. General The assessment costs contained herein are for mintenance only. The costs of inprovements, as previously stated, will be contributed by the developer of Tract 10513 with no costs of such inprovements assessed against the lands. As construction of Tract 10513 is currently in progress, cost estimates are based on City assumption of mintenance on January 1, 1980. B. SECTION V ZONES OF BENEFIT All of the parcels in Tract 10513 will benefit equally from the maintenance of the landscaped areas designated as Lots A, B, C, and D on Appendix B. Therefore, no zones of benefit have been established, and all parcels will share equally in the assessment for maintenance.
