RESOLUTION NO. 79-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, MAKING FINDINGS ON SUPPLEMENTAL PETITION AND WAIVER REGARDING PROPOSED ASSESSMENT DISTRICT NO. 79-01 (SOUTH COAST DRIVE). WHEREAS, this City Council has previously received a Petition requesting the construction of certain public works of improvements, together with appurtenances and appurtenant work, in a special assess- ment district pursuant to the terms and provisions of the "Municipal Improvement Act of 1913," being Division 12 of the Streets and Highways Code of the State of California, said special assessment district being known and designated as ASSESSMENT DISTRICT NO. 79-01 (SOUTH COAST DRIVE) (hereinafter referred to as the "Assessment District"); and WHEREAS, at this time there has been submitted a Supplemental Petition by property owners requesting the construction of certain additional works of improvements other than those previously so requested and included within the previously -filed Petition; and WHEREAS, said Supplemental Petition contains a waiver of the pro- visions and limitations of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," as provided for in Section 2804 of said Act; and WHEREAS, it has been reported that said Supplemental Petition and Waiver contains the signatures of owners representing more than sixty percent (60%) in area of the property to be subject to assessment for said proposed improvements. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA CALIFORNIA, AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the City Council finds that said Supplemental Petition and Waiver has been signed by owners representing more than sixty percent (60%) in area of the property to be subject to assessment for the improvements requested in said Petition and meets the require- ments of Section 2804 of Division 4 of the Streets and Highways Code of the State of California. SECTION 3. That the works of improvement as requested by said Supplemental Petition shall be consolidated with the works of improve- ments as proposed for the above -referenced Assessment District, and said work shall be done by a single proceeding under the provisions of said "Municipal Improvement Act of 1913." SECTION 4. That said Petition and Waiver shall be filed in the Office of the City Clerk of said City. APPROVED and ADOPTED this 28th day of June, 1979.
