HomeMy WebLinkAbout79-130 - Amending Personnel Rules, OvertimeRESOLUTION NO. 79-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, AMENDING SECTION 1 OF RULE 13 OF THE RULES AND REGULATIONS FOR ADMINISTRATION OF THE PERSONNEL SYSTEM OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa, through its management team, meeting and conferring in good faith with the Costa Mesa Police Associa- tion, has discussed rule change; and WHEREAS, the City Council of the City of Costa Mesa finds that it is in the best interest of the City and in keeping with sound personnel practices that: Rule 13, Section 1 of the Personnel Rules and Regulations be amended as follows, effective November 5, 1979. RULE 13. ADDITIONAL PAY AND PAY ADJUSTMENT. Section 1. OVERTIME If an employee is required to work longer than his normal work week or work shift, said employee shall be compensated for said approved overtime by being allowed either a like number of working hours off, without deduction from the employee's salary or compensation, or through payment for such overtime at the prevailing rate paid to the employee. The determination of method is to be at the discretion of the department head and with the approval of the City Manager. Compensa- tion for said overtime shall normally be included with compensation for the pay period in which such overtime occurs. An employee may, with the department head's approval, accumulate compensatory time to be taken during subsequent pay periods, with departmental approval, to a maximum accumulation of fifty (50) hours for eligible sworn Police and Fire employees and forty (40) hours for all other eligible employees. Addi- tionally, effective December 30, 1979, sworn Police employees shall be compensated at one and one-half times the employee's prevailing rate only when required to work overtime as a uniformed division officer beyond 85 hours per bi-weekly pay period. This provision is not applicable to compensatory time in lieu of payment for overtime nor for any other type of overtime assignment. Only employees in classifications in the Basic Pay Schedule will be eligible for compensated overtime as stated in the above paragraph.
