HomeMy WebLinkAbout80-118 - Amending Rules and Regulations, Personnel SystemAt 01 1 RESOLUTION NO. 80-118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, AMENDING CERTAIN PORTIONS OF THE RULES AND REGULATIONS FOR ADMINISTRATION OF THE PERSONNEL SYSTEM OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa, through its management team, meeting and conferring in good faith with the Employees Organizations of the City of Costa Mesa, has discussed certain rule changes; and WHEREAS, the City Council of the City of Costa Mesa finds that it is in the best interest of the City and in keeping with sound personnel practices that: Rules 12, 13, 16, 23 and 27 of the Personnel Rules and Regulations be amended as follows, Rule 12. ATTENDANCE AND LEAVES Section 7. Maternity Leave of Absence Due to changes in equal employment opportunity laws and regu- lations, this section is hereby deleted in its entirety as the pro- visions for maternity leave of absence are covered under Section 3 F and Section 4. Rule 13. ADDITIONAL PAY AND PAY ADJUSTMENT Section 1. Overtime If an employee is required to work longer than his normal work week or work shift, said employee shall be compensated for said approved overtime by being allowed either a like number of working hours off, without deduction from the employee's salary or compen- sation, or through payment for such overtime at the prevailing rate paid to the employee. The determination of method is to be at the discretion of the department head and with the approval of the City Manager. Compensation for said overtime shall normally be included with compensation for the pay period in which such overtime occurs. An employee may, with the department head's approval, accumulate compensatory time to be taken during subsequent pay periods, with departmental approval, to a maximum accumulation of fifty (50) hours for eligible sworn Police and Fire employees and forty (40) hours for all other eligible employees. Additionally, effective 12-14-80 employees in job classifica- tions in the Police Unit, as determined by the City, shall be com- pensated at one and one-half times the employee's regular salary rate only when required to work overtime beyond the employee's normal work shift. Additionally, as of 7-12-81, all employees in job classifications on the Basic Salary Resolution except the classifications of Fire Fighter, Fire Fighter Specialist, and Fire Captain, shall be compensated at one and one-half times the employ- ee's regular salary rate when required to work overtime beyond the employee's normal work shift. These time and one-half provisions do not apply to voluntary overtime, standby time, compensatory time, or other such times when an employee would normally work more than one work shift in twenty-four hours because of shift changes, relief shift scheduling and such like. Only employees in classifications in the Basic Pay Schedule will be eligible for compensated overtime as stated in the above paragraph. Rule 16. OUTSIDE EMPLOYMENT An employee in the classified service may not engage in employ- ment, other than his job with the City of Costa Mesa, except with the approval of his department head and only if such employment does not interfere with the performance of assigned duties and does not constitute a conflict of interest. An employee injured on his outside employment may not use his accrued sick leave credit and such employee must be covered by such outside employer's workers compensation insurance, and employees working as self-employed individuals must agree to hold harmless and indemnify the City. Rule 23. EMPLOYEE REPRESENTATION Section 3. Recognition of Employee Organization (9) a statement that the employee organization has no restrictions on membership based on race, color, creed, sex, national origin, age or physical handicap. Rule 27. GRIEVANCE PROCEDURE Section 2. Matters Subject to Grievance Procedures A. Any alleged violation of the Personnel Ordinance or Per- sonnel Rules, any alleged improper treatment of an employee and/or any decision affecting an employee's employment having material impact shall be considered to be a matter subject to review through the grievance procedure.
