Home My WebLink About81-37 - Ordering Monte Vista No. 4 Annexed without Hearing or ElectionRESOLUTION NO. 81-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING AND ORDERING TERRITORY KNOWN AS MONTE VISTA NO. 4 ANNEXATION ANNEXED TO THE CITY OF COSTA MESA WITHOUT HEAR- ING OR ELECTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 11th day of February, 1981, approve the annexa- tion of certain territory described as Monte Vista No. 4 Annexation to the City of Costa Mesa, after application having been made for said annexation pursuant to Section 35000 et seq, California Government Code, and accompanied by written consent of one hundred percent (100%) of the land owners within the territory; NOW, THEREFORE, the City Council of the City of Costa Mesa, Cali- fornia, finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten per- cent (10%) of the number of land owners in the territory proposed to be annexed, owning not more than ten percent (10%) of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexa- tion. (d) That the territory to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city or similar purpose. (e) That the determination of Categorically Exempt issued by the Executive Officer of the Orange County Local Agency Formation Commission, pursuant to the California Environmental Quality Act of 1970, was considered and adopted by the Local Agency Formation Commission on February 11, 1981, by Resolution 81-16. (f) That the Negative Declaration of Environmental Impact in con- nection with Rezone Petition R-81-01, Margarete Lukas, was accepted by the Costa Mesa City Council on February 17, 1981. The City Council has hereby ordered the annexation of Monte Vista No. 4 Annexation in accordance with Resolution 81-16 of the Local Agency Formation Commission without notice and hearing and without an election, pursuant to Section 54797.1 of the California Government Code. That for taxing purposes, said Annexation is to be deemed an annexation in the "Basic Area" of the City of Costa Mesa and the Orange County Assessor is so notified. That the exterior boundaries of the territory annexed are as set forth on a map and legal description attached hereto, marked Exhibit "A", and by this reference made a part hereof.
