HomeMy WebLinkAbout81-70 - Approving Assessment District 80-1 Record, Levying Assessment for 1981-82245 RESOLUTION NO. 81-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING AUDITOR'S RECORD FOR SPECIAL ASSESSMENT DISTRICT. WHEREAS, The City Council of the City of Costa Mesa, California, (hereinafter referred to as "Agency"), has heretofore undertaken pro- ceedings under the "Municipal Improvement Act of 1913," being Division 12 of the Streets and Highways Code of the State of California, and has confirmed an assessment upon the district described in its Resolution of Intention previously adopted, for the construction of certain public works of improvement in a special assessment district known and desig- nated as: ASSESSMENT DISTRICT NO. 80-01 (SUNFLOWER/MAC ARTHUR INDUS- TRIAL AREA), (hereinafter referred to as the "Assessment District"); and WHEREAS, said proceedings provided for the issuance of bonds pursuant to the "Improvement Bond Act of 1915," being Division 10 of the Streets and Highways Code of the State of California; and WHEREAS, the assessment and diagram in said proceedings has been recorded with the Superintendent of streets of said Agency in the manner and form required by law, and specifically, pursuant to Section 10600 of the Streets and Highways Code of the State of California, and notice of assessment has been recorded with the County Recorder pursuant to Section 3114 of said Streets and Highways Code; and WHEREAS, following the elapse of thirty (30) days after the date of recording of said assessment, there has been prepared a complete list of all paid and unpaid assessments, a copy of which list is on file in the Office of the Treasurer, and this Agency has previously considered and approved said list and has determined that the same is an accurate statement thereof; pursuant to Section 8682 of the Streets and Highways Code; and WHEREAS, at this time, this Agency is further desirous of approv- ing the Auditor's Record of Improvement Bonds, said record containing a complete breakdown of each installment of every assessment showing interest and amount of principal to be collected upon each assessment within said Assessment District for the forthcoming year. NOW THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. The above recitals are all true and correct. SECTION 2. The Auditor's Record of Improvement Bonds is hereby approved for the Special Assessment District. SECTION 3. The Auditor of the County of Orange,, which said last mentioned political subdivision of the State of California is the County which collects taxes for said Agency, is hereby requested and directed, in accordance with the provisions of Section 8682 of the Streets and Highways Code of the State of California, to enter in his assessment roll on which taxes will next become due, opposite each lot or parcel of land affected in a space marked "public improvement assessment," or by other suitable designation, the several installments of such assess- ment roll and that such entry be made each year during the life of the bonds to be issued in said proceedings. SECTION 4. In accordance with the provisions of Section 8685 of the Streets and Highways Code, if any lot or parcel of land affected by an assessment is not separately assessed on the tax roll so that the installment to be collected can be conveniently entered thereon, then the Auditor shall enter on the roll a description of the lot or parcel affected with the name of the owners, if known, but otherwise the owners may be described as "unknown owners," and extend the proper installment opposite the same. 246' SECTION 5. The County Auditor shall, at the close of the tax collecting season, as specified in Section 8683 of the Streets and Highways Code, promptly render to the Agency a detailed report showing the amounts of such installments, interest, penalties and percentages so collected on each proceeding and from what property collected, and also giving a statement of the percentages retained for the expense of making such collections. SECTION 6. Each ensuing year, said Agency shall provide to the County, the Auditor's Report setting forth the installments of assess- ments coming due for the ensuing fiscal year, and said County shall collect said special assessments pursuant to law during the life of said bonds for said Assessment District.
