RESOLUTION NO. 81-74
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, SUPPORTING PARTICIPATION
IN THE ORANGE COUNTY ENERGY ASSOCIATION.
WHEREAS, the City of Costa Mesa is concerned about energy conser-
vation and the future availability of energy resources to serve the
citizens of this community; and
WHEREAS, the City has actively participated in energy related
efforts with other governmental jurisdictions which share similar
concerns; and
WHEREAS, there is a need for joint efforts between government and
business to meet present and future needs;
NOW, THEREFORE, the City Council of the City of Costa Mesa does
hereby resolve as follows:
1. To become an active member of the Orange County Energy
Association.
2. To adopt the Memorandum of Understanding as attached hereto as
Exhibit I.
PASSED AND ADOPTED this 17th day of August, 1981.

I, EILEEN P. PHINNEY, City Clerk and ex -officio Clerk of the City
Council of the City of Costa Mesa, hereby certify that the above and

EXHIBIT I
PROPOSAL FOR ORANGE COUNTY
ENERGY ASSOCIATION
I
PREAMBLE
This Memorandum of Understanding is entered into by the Cities of Anaheim,
Costa Mesa, Fullerton, Garden Grove, La Habra, and Orange, and the County of
uranae, for the purpose of assuring the most cooperative, expeditious, and ;

RECITALS
A. The County is a legal subdivision of the State of California
pursuant to Section 23000 of the California Government Code.
B. The Cities are municipal corporations organized under the laws
of the State of California.
C. The Cities and the County have a common interest in reducing
their respective energy costs, vulnerability to energy shortfalls
and accelerating the utilization of new cost-effective energy
management systems and renewable energy technologies.
D. The Cities and the County recognize the need to enhance their
respective energy management programs through cooperative arrange-
ments without increasing administrative costs as a result of such
cooperative arrangements.

E. The Cities and the County recognize that there will be specific
instances when it is in their mutual best interest to collectively
support and participate administratively and financially in the
application of new energy management programs and technologies.

NOW, THEREFORE, in consideration of the mutual benefits to the parties

fD hereto, to the expeditious introduction of cost-effective energy management programs

and technologies within the County of Orange, and in consideration of the covenants
and conditions herein contained, the parties do hereby agree as follows:
A. To the establishment of the Orange County Local Government Energy
Association.
B. To jointly engage, through the Association, in efforts to review new
or existing energy management programs and technologies as they may
relate to city/county operations and/or responsibilities.
C. To, without necessarily committing funds, provide policy support for
grant applications submitted by the Association to Federal and State
agencies.
D. To consider the testing and application of new energy programs and
technologies on behalf of the Association, and to provide Association
members with test results.
E. To designate a specific position/person to represent their respective
entity.
F. That unless there is specific action taken during public meetings
of the member parties in support of any proposed action of the
Association, the member parties are not obligated in any manner
or form.

G. Additional Orange County Cities may become members of the

Associaition if they agree to the conditions of this Memorandum of
Understanding.
H. This Memorandum of Understanding may be amended or modified by a
majority of the Association members. Notification of intent to
modify this Memorandum must be made not less than three weeks
prior to such modification.
