RESOLUTION NO. 81-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA APPROVING THE FORM AND AUTHORIZING
THE EXECUTION OF AN EQUIPMENT/LEASE PURCHASE
AGREEMENT AND RELATED DOCUMENTS NECESSARY FOR
THE ACQUISTION AND FINANCING OF A POLICE
RECORDS MANAGEMENT SYSTEM, A COMPUTER ASSISTED
DISPATCH SYSTEM AND A MOBILE DIGITAL TERMINAL
SYSTEM.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
THAT, WHEREAS, the City Council of the City of Costa Mesa (the
"City") has determined that the existing police records and police
dispatch system for the City are obsolete, and the installation of a
modern, computer -controlled police records management system, a com-
puter assisted dispatch system and a mobile digital terminal system
(the "Police Computer System") would improve the police services to
the residents of the City; and
WHEREAS, following receipt and evaluation of various proposals
for the Police Computer System in accordance with the procurement
rules and regulations of the City, said City Council has determined
the PRC Public Management Services, Inc. ("PRC/PMS") is the best
and least costly source of such a system; and
WHEREAS, an agreement with PRC/PMS for the acquisition of the
Police Computer System for the City has been executed and the documen-
tation necessary to consummate an appropriate lease -purchasing financing
for said system has been prepared and submitted to the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa as follows:
1. In order to protect and preserve the public peace, health and
safety of the residents of the City and to acquire property necessary
and proper for the municipal purposes, the City Council hereby author-
izes lease -purchase financing for the Police Computer System; provided
that the aggregate maximum principal amount of rental payments specified
in the documents hereinafter referred to shall not exceed $526,665.60.
2. The proposed form of equipment lease/purchase agreement, dated
as of November 1, 1981, between the City and Crocker National Bank, a
national banking association, presented to the City Council and on file
with the City Clerk, is hereby approved. The City Council hereby
specifically finds and declares that the statements of fact set forth
in Section 2.01 of said form of equipment lease/purchase agreement are
true and correct. The Mayor is hereby authorized and directed, for
and in the name and on behalf of the City, to execute, acknowledge and
deliver an equipment lease/purchase agreement in substantially said
form, with such additions as to rental payments and purchase prices
and such other changes therein as the Mayor, in consultation with the
City Manager, may require or approve, such approval to be conclusively
evidenced by the execution and delivery thereof.
3. The City Clerk is hereby authorized and directed to attest the
signature of the Mayor and to affix and attest the seal of the City as
may be required in connection with the execution and delivery of said
equipment lease/purchase agreement.
4. The Mayor, City Manager and other officers of the City are
hereby authorized and directed, jointly and severally, to do any and
all things and to execute and deliver any and all documents which they
may deem necessary or advisible in order to consummate the execution and
delivery of said equipment lease/purchase agreement and to otherwise
consummate the lease/purchase financing herein authorized, and otherwise
to carry out, give effect to and comply with the terms and intent of
this resolution and said equipment lease/purchase agreement.
5. This resolution shall take effect immediately upon its passage.
