HomeMy WebLinkAbout83-40 - Airport Environs Land Use PlanRESOLUTION NO. 83-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, PROVIDING COMMENTS ON THE PROPOSED REVISIONS TO THE AIRPORT ENVIRONS LAND USE PLAN PREPARED BY THE AIRPORT LAND USE COMMISSION FOR ORANGE COUNTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, the Airport Land Use Commission (ALUC) of Orange County has prepared draft revisions to the current Airport Environs Land Use Plan (AELUP) dated August, 1975; and WHEREAS, the proposed revisions will result in an expansion of the Planning Area boundaries for John Wayne Airport -Orange County through the incorporation of Part 77 of the Federal Aviation Regulations (FAR) relating to building height restrictions within specified distances of John Wayne Airport -Orange County; and WHEREAS, the proposed revisions to the current AELUP do not include provisions for the review and the approval of buildings which exceed the limits of FAR Part 77; and WHEREAS, strict application of the FAR Part 77 height limitations may result in unreasonable restrictions on the use of property and on the development of buildings which encroach into the imaginary surfaces estab- lished by FAR Part 77 but which, according to expert analysis, do not constitute a hazard to air navigation; and WHEREAS, adoption of the proposed revisions to the adopted AELUP without specific written procedures to allow for the review .and the approval of buildings which encroach into the imaginary surfaces estab- lished by FAR Part 77 but which, according to expert analysis do not constitute a hazard to air navigation, may create significant and unreason- able constraints and restrictions on future development proposals for such buildings within the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa opposes the adoption of the revised AELUP as dated January 20, 1983; BE IT FURTHER RESOLVED that the City Council of the City of Costa Mesa recommends that the Airport Land Use Commission for Orange County include specific written procedures into the revised AELUP which would allow for the review and the approval of buildings which encroach into the imaginary surfaces of FAR Part 77 but which, according to expert analysis, will not constitute a hazard to air navigation.
