A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUR
UTILITY DISTRICT NUMBER 15 ON SUNFLOWER AVENUE
FROM EAST OF FUCHSIA STREET TO FLOWER STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, a public hearing was called for April 18, 1983, at the hour
of 6:30 p.m., in the Council Chambers of City Hall, Costa Mesa, California,
to ascertain whether the public necessity, health, or welfare requires
the underground installation of wires and facilities for supplying electri-
cal, communication, or similar or associated service, within that certain
area of Costa Mesa described as follows:
PARCEL 1
A strip of land 140.00 feet in width, being 70.00 feet on both
sides of and adjoining the following described line:
Beginning at a point 2,785.91 feet west of the intersection of
Main Street and Sunflower Avenue as shown on a map recorded in
Book 7, Page 35, Records of Surveys, Records of the County
Recorder, Orange County, California (said point also being 100.00
feet west of the intersection of Flower Street and Sunflower
Avenue); thence westerly along the centerline of said Sunflower
Avenue to the intersection of Sunflower Avenue and Bear Street as
shown on Tract No. 8858 in the City of Costa Mesa, recorded in
Book 357, Page 26 of Miscellaneous Maps, Records of said County
Recorder.
PARCEL 2
Beginning at the intersection of Sunflower Avenue and Bear Street
as shown on said Tract No. 8858; thence south 0048130" east 70.00
feet; thence south 89111130" west 60.00 feet to a point on a
tangent curve concave northerly and having a radius of 1,070 feet;
thence northwesterly along said curve through a central angle of
30039140" an arc distance of 572.60 feet; thence north 49°00100"
west 521.09 feet; thence north 0048130" west 134.18 feet; thence
south 49000100" east 387.70 feet; thence south 60043142" east
along a line 185.62 feet to a point on a curve concave northerly
and having a radius of 930.00 feet; thence southeasterly along
said curve through a central angle of 30039140" an arc distance
of 497.68 feet; thence north 89011130" east 60.00 feet; thence
south 0048130" east 70.00 feet to the point of beginning.
PARCEL 3
A strip of land 100.00 feet in width, being 50.00 feet on both
sides of and adjoining the following described line:
Beginning at a point on the centerline of Sunflower Avenue, said
point being 53.67 feet south 0148'30" east of the point of begin-
ning of Parcel No. 1 as shown on that certain judgment in condem-
nation entered in Book 322, Page 326 of Judgments and recorded in
Book 8880, Page 634 of Official Records of the County Recorder,
Orange County, California; thence northwesterly and westerly
along said centerline of Sunflower Avenue to a point 355.00 feet
east of the northwest corner of Tract No. 7718 in the City of
Costa Mesa as recorded in Book 303, Page 35 of Miscellaneous
Maps, Records of said County Recorder, (said point also being
230.00 feet east of the centerline of Fuchsia Street as shown
on said tract).
All as more particularly shown on the map attached hereto and
made a part hereof.
WHEREAS, notice of such hearing has been given to all affected
property owners as such shown on the last equalized assessment roll and
to all utilities concerned in the manner and time required by law; and
WHEREAS, such hearing has been duly and regularly held and all persons
interested have been given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa, that pursuant to Title 13, Chapter VIII, Sections 13-684 through
13-700, Costa Mesa Municipal Code, the above described area is hereby
declared an Underground Utility District and is designated as Underground
Utility District No. 15 of the City of Costa Mesa. Attached hereto marked
Exhibit "A" and hereby incorporated as a part of this Resolution is a map
delineating the boundaries of said District.
BE IT FURTHER RESOLVED that the Council does hereby fix January 1,
1985, as the date on which affected property owners must be ready to
receive underground service, and does hereby order the removal of all poles,
overhead wires, and associated overhead structures, and the underground
installation of wires and facilities for supplying electrical, communica-
tion, or similar or associated service within Underground Utility District
No. 15 on January 1, 1985.
BE IT FURTHER RESOLVED that the following exception in said Under-
ground Utility District No. 15 be, and they are hereby authorized:
(1) Any Municipal facilities or equipment installed under the
supervision and to the satisfaction of the City Engineer.
(2) Poles or electroliers used exclusively for street lighting
(or traffic signals).
(3) Overhead wires (exclusive of supporting structures) crossing
any portion of a District within which overhead wires have
been prohibited, or connecting to a building on the perimeter
of a District, when such wires originate in an area from
which poles, overhead wires, and associated overhead struc-
tures are not prohibited.
(4) Antennae, associated equipment, and supporting structures,
used by a utility for furnishing communication services.
(5) Equipment appurtenant to underground facilities such as
surface -mounted transformers, pedestal -mounted terminal
boxes and meter cabinets, and concealed ducts.
(6) Temporary poles, overhead wires, and associated overhead
structures used or to be used in conjunction with con-
struction projects.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property within
Underground Utility District No. 15 of the adoption of this Resolution
within ten (10) days after the date of such adoption. Said City Clerk
shall further notify said property owners of the necessity that, if they
or any person occupying such property desires to continue to receive elec-
tric, ccmmunication, or other similar or associated service, they or such
occupant shall, by the date fixed in this Resolution, provide all necessary
facility changes on their premises so as to receive such from the lines of
the supplying utility or utilities at a new location, subject to applicable
rules, regulations, and tariffs of the respective utility or utilities
on file with the Public Utilities Commission of the State of California.
Such notification shall be made by mailing a copy of this Resolution,
together with a copy of said Sections 13-684 through 13-700 of the
Costa Mesa Municipal Code, to all affected property owners as such are
shown on the last equalized assessment roll and to the affected
utilities.
BE IT FINALLY RESOLVED that the City Council hereby finds and deter-
mines as follows:
The Underground Utility District herein created is in the general
public interest for the following reasons:
(1) The undergrounding will avoid or eliminate an unusually
heavy concentration of overhead distribution facilities.
(2) The streets and rights of way in the District are exten-
sively used by the general public and carry a heavy volume
of pedestrian and vehicular traffic.
