HomeMy WebLinkAbout83-108 - Negotiations with Copley/Colony CablevisionX59 RESOLUTION NO. 83-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COS9A MESA, CALIF01VIA, AUTHORIZING THE CITY MANAGER TO ENTER INTO NEGOTIATICNS WITH COPLEY/ COLONY CABLEVISION OF COSTA MESA, INCORPORATED, FOR THE AV,ARD OF A NCN-EXCLUSIVE FRANCHISE FOR CABLE 094EN ICATIONS SERVICES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, the City Council of the City of Costa Mesa adopted Ordinance No. 83-2 on February 23, 1983, setting forth requirements and minimum standards for Community Antenna Television Systems; and WHEREAS, on April 13, 1983, the City offered Requests for Proposals to award a non-exclusive franchise for cable communication services for the City pursuant to Ordinance No. 83-2; and WHEREAS, proposals from interested cable operators were received on July 29, 1983, in response to the Request for Proposals for the cable communications systems franchise; and WHEREAS, the proposals submitted by interested cable operators were evaluated by a qualified technical consultant and City staff in accordance with the requirements of the Federal Communications Commission, applicable State law, Ordinance No. 83-2 of the City of Costa Mesa, and accepted industry standards; and WHEREAS, the proposal submitted by Copley/Colony Cablevision of Costa Mesa, Incorporated, has been determined to meet the preceding requirements and commands the requisite financial, management, and technical expertise to construct and operate a high quality cable communications system; and WHEREAS, the City desires to enter into negotiations with Copley/ Colony Cablevision of Costa Mesa, Incorporated, for the purpose of entering into an agreement for providing cable communication services to the commun- ity; NOW, THEREFORE, BE IT RESOLVED that the City Manager or his designee is hereby authorized to enter into negotiations with Copley/Colony Cable- vision of Costa Mesa, Incorporated, for the determination of the terms of the final franchise agreement for the cable communications system. BE IT FURTHER RESOLVED that pursuant to Costa Mesa Municipal Code Section 19-160 et seq., the time for such negotiations shall not exceed ninety (90) days and that the proposed final franchise agreement be brought back for City Council approval.
