HomeMy WebLinkAbout84-61 - Intention to Levy and Collect Assessments, Landscaping Assessment District No. 11.6,3 RESOLUTION NO. 84-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTEN'T'ION TO LEVY AND COLLECT ASSESSMENTS DURING FISCAL YEAR 1984-1985 WITHIN CITY OF COSTA MESA LAND- SCAPING ANDSCAPING ASSESSMENT DISTRICT NUMBER 1. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, on April 2, 1984, this Council adopted Resolution No. 84-43, initiating proceedings for renewal of City of Costa Mesa Landscaping Assessment District Number 1 and ordering the Project Manager to prepare a report with respect to said district pursuant to Section 22565 through and including Section 22574 of the California Streets and Highways Code; and WHEREAS, said report has been prepared and filed with the City Council; and WHEREAS, the City Council has approved said report as filed; NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: 1. The City Council hereby declares its intention to levy and collect assessments pursuant to Part -2, Division 15, of the Streets and Highways Code of the State of California during fiscal year 1984-1985 within City of Costa Mesa Landscaping Assessment District Number 1, located generally south of Sunflower Avenue and east of Smalley Road and more particularly described in the report labeled Exhibit "A", attached hereto and incorpor- ated herein by reference. 2. A general description of the improvements relevant to said dis- trict is as follows: The maintenance and possible future replacement of landscaping and any facilities which are appurtenant thereto, or which are necessary or convenient for the maintenance or possible future replacement thereof, including removal of debris, and maintenance and repair of water irrigation or drainage facilities on lettered Lots B and C of Tract 9901. No substantial changes are proposed to be made in existing improvements. 3. Reference is hereby made to the report of the Project Manager relating to the said district. Said report is on file with the City Clerk of the City of Costa Mesa and contains a full, detailed description of the improvements, the boundaries of the proposed assessment district, and the proposed assessments upon assessable lots and parcels of land within City of Costa Mesa Landscaping Assessment District Number 1. Said report is attached hereto as Exhibit "A" and incorporated herein by reference. 4. The City Council hereby fixes 6:30 p.m., or as soon as possible thereafter, on June 4, 1984, at the Costa Mesa City Council Chambers, 77 Fair Drive, Costa Mesa, California, as the time and place for a hearing before this Council on the levy and collection of the proposed assessments within City of Costa Mesa Landscaping Assessment District Number 1, and hereby gives notice of said hearing. 5. The City Clerk shall certify to the adoption of this Resolution and shall cause a true and correct copy of this Resolution to be published at least 10 days prior to said hearing in the manner required by Section 6061 of the Goverment Code, and to be posted on the bulletin board in the lobby of the Costa Mesa City Hall. O F� z�H. fr 0 O D co �P I CITY OF COSTA MESA CITY ENGINEER'S REPORT FOR CITY OF COSTA MESA LANDSCAPING ASSESSMENT DISTRICT NO. 1 FISCAL YEAR 1984-85 EXHIBIT "A" SECTION I INTRODUCTION This report has been prepared and is submitted for renewal to the City Council of the City of Costa Mesa, under authority of the Landscape and Lighting Act of 1972 of the Streets and Highways Code of the State of California. SECTION II BACKGROUND 1O i This Landscaping Assessment District has been formed as a result of Specific Plan SP 76-03. This Specific Plan set as a development standard for the area in o question that a "private mandatory homeowner's association or landscape assess- 4J S N ment district must be established," and that "such an association or assessment -A ro district shall be responsible for the maintenance of the required setbacks along Smalley Road and Sunflower Avenue." m w SECTION III DESCRIPTION A. General A diagram of the City of Costa Mesa Landscaping Assessment District No. 1 is included herein. The District is located on the southeast corner of Sunflower Avenue and Smalley Road. The lands within the District are desig- nated as Tract 9901 which has received approval of the Planning Commission and the City Council of the City of Costa Mesa. Plans and Specifications Plans and Specifications for the improvement of this project are on file in the office of the Planning and Development Services Department. These plans include the installation of landscaping and an irrigarion system as required by the City's conditions for development. The plans and specifications are hereby incorporated into this report by reference. C. Estimate of the Costs of the Improvements No improvement costs will be assessed All such improvements were contributed to development for Tract 9901. Maintenance of this report. D. Assessment Diagram against the lands within the District. the District as a condition of costs are discussed in Section IV A diagram of the Assessment District entitled "City of Costa Mesa Landscaping Assessment District No. 1 in the City of Costa Mesa, County of Orange, State of California, is included herein as Appendix B. E. Lines and Dimensions The boundaries of the District are described as being all of Tract 9901, City of Costa Mesa, County of Orange, as per map recorded in Book 417, page 49 of Miscellaneous Maps in the office of the County Recorder of Orange County, State of California. Lots 1 through 50 of Tract No. 9901 in the City of Costa Mesa, County of Orange. SECTION IV m ro ASSESSMENT D rGt r (D r• H. w rt A. General The assessment costs contained herein are for maintenance only. The costs co of improvements, as previously stated, have been contributed by the developer a,of Tract 9901 with no costs of such improvements assessed against the lands. B. Basis for Cost Data Maintenance cost estimates are based on previous years' experience, with adjustments to anticipate future conditions. Maintenance costs for Fiscal Year 1983-84 are based on actual costs from July 1, 1983 through March 31, 1984, and estimated costs from April 1, 1984 through June 30, 1984. Adjustments for actual fourth quarter costs will be included in the 1984-85 report. C. SECTION V ZONES OF BENEFIT All of the parcels in Tract 9901 will benefit equally from the maintenance of the landscaped areas designated as Lots B and C on Appendix B.
