HomeMy WebLinkAbout84-74 - Intention to Annex to Landscaping Assessment District No. 1133 RESOLUTION NO. 84-74 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE ANNEXATION OF CERTAIN PROPERTY TO CITY OF COSTA MESA LANDSCAPING ASSESSMENT DIS- TRICT NO. 1. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa Planning Commission approval of Tentative Tract 12011 on August 8, 1983, contained a condition which states "a private, mandatory homeowners association or a landscaping assessment district for the maintenance of the required setbacks along Smalley Road shall be established"; and WHEREAS, the property located within Tract 12011 is immediately adjacent to and contiguous with the boundaries of City of Costa Mesa Land- scaping Assessment District No. 1; and WHEREAS, the annexation of property located within Tract 12011 to City of Costa Mesa Landscaping Assessment District No. 1 will provide a more efficient and expedious means to comply with the above -noted Condition of Approval than the establishment of a separate landscaping assessment district for Tract 12011; and WHEREAS, this Council did adopt Resolution 84-57 proposing the annexa- tion of property included in Tract 12011 to City of Costa Mesa Landscaping Assessment District No. 1 on May 7, 1984; and WHEREAS, this Council did find that the annexation of property con- tained within Tract 12011 to City of Costa Mesa Landscaping Assessment District No. 1 did comply with provisions of Article 2 (Changes of organi- zation for Assessment District) of the Landscaping and Lighting Act of 1972 which allows annexations to existing landscaping assessment districts without notice and hearing or filing of an engineer's report for both; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby find, determine, and resolve as follows: 1. The City Council hereby declares its intention to order the annexation of certain property encompassed by Tract 12011 and more particu- larly described in Exhibit "A", attached hereto and incorporated by refer- ence, to City of Costa Mesa Landscaping Assessment District No. 1, and to levy and collect assessments pursuant to Part Two of Division 15 of the Streets and Highways Code of the State of California. 2. A general description of the improvements relevant to said dis- trict is as follows: The maintenance and possible future replacement of landscaping and any facilities which are permanent thereto, or which are necessary or convenient for the maintenance or possible future replacement thereof, including the removal of debris, clearing, the maintenance and repair of water irrigation or drainage facilities on lettered Lots B and C of Tract 9901 and on lettered Lots A and B of Tract 12011. 3.
