A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, CERTIFYING THAT THE CITY
COUNCIL HAS REVIEWED AND CONSIDERED THE INFOR-
MATION
NFORMATION CONTAINED IN THE FINAL SUPPLEMENTAL ENVIRON-
MENTAL IMPACT REPORT WITH RESPECT TO THE CERTAIN
PROPERTY WITHIN THE 16 -ACRE DEVELOPMENT AREA IN
THE COSTA MESA DOWNIOWN REDEVELOPMENT PROTECT; AND
MAKING CERTAIN FINDINGS REGARDING THE ENVIRONMENTAL
IMPACT OF THE PROPOSED DEVELOPMENT; AND ADOPTING A
STATEMENT OF OVERRIDING CONSIDERATIONS.
WHEREAS, the City Council of the City of Costa Mesa (the "Council")
by Ordinance No. 73-44 on December 24, 1973, adopted and approved the
Redevelopment Plan for the Costa Mesa Downtown Redevelopment Project; and
amended by Ordinance No. 77-27 on July 5, 1977, Ordinance No. 77-36 on
August 1, 1977, and Ordinance No. 80-22 on November 17, 1980 (the "Re-
development Plan") ; and
WHEREAS, the Costa Mesa Redevelopment Agency, City of Costa Mesa,
(the "Agency") proposes to enter into an agreement with a private developer
for the disposition of certain property and the development of a retail
shopping center and the necessary landscaping and parking on a certain
"Site" within the Costa Mesa Downtown Redevelopment Project area; and
WHEREAS, the Agency has caused to be prepared a Supplemental Environ-
mental Impact Report (Supplemental EIR) with respect to the proposed
development of the Site and other discretionary actions necessary to
development of the Site in implementing said Redevelopment Plan; and
WHEREAS, said Supplemental EIR supplements the Environmental Impact
Report for the Costa Mesa Downtown Redevelopment Project which was prepared
for the Redevelopment Plan, which Final Environmental Impact Report was
certified by the City Council by Resolution No. 73-131 and the Agency by
Resolution No. 8-73 on December 17, 1973; and
WHEREAS, a Draft Supplemental EIR has been prepared and circulated
pursuant to the California Environmental Quality Act of 1970 (CEQA), and
State and local regulations and guidelines adopted pursuant thereto; and
WHEREAS, a duly noticed public hearing was held by the City Council
on February 6, 1984, at which time all interested persons were given an
opportunity to be heard; and
WHEREAS, the Final Supplemental EIR relating to the proposed develop-
ment, including responses to the concerns raised at the public hearing and
during the public review period, has been prepared pursuant to said statute,
regulations and guidelines; and
WHEREAS, the City Council has reviewed and considered the information
contained in the Final Supplemental EIR as certified.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa, as follows:
1. The City Council hereby certifies that the information contained in
the certified Final Supplemental EIR and the information contained
in the certified Final EIR for the Costa Mesa Downtown Redevelop-
ment Project has been reviewed and considered by the Members of
the City Council.
2. The City Council hereby finds with respect to the adverse environ-
mental impacts detailed in the Final Supplemental EIR:
a. That the adverse environmental impacts of the proposed develop-
ment set forth in the Final Supplemental EIR, including those
raised in comments to the Draft Supplemental EIR, have been
considered and recognized by the City Council;

b. That based on information set forth in the Final Supplemental
EIR and in Attachment "A" (attached hereto and incorporated
herein by this reference), the City Council finds and deter-
mines that measures have been incorporated into the development
project which mitigate or avoid each of the adverse environ-
mental impacts relating to land use, traffic and circulation,
noise, air quality, energy consumption/conservation, water
supply, sewage, drainage, police protection and fire protec-
tion identified in the Final Supplemental EIR and set forth
in Section I of Attachment "A";
C. That no additional adverse impacts will have a significant
effect or result in a substantial or potentially substantial
adverse change in the environment as a result of the proposed
development.
3. The City Council hereby finds and determines that all significant
environmental effects identified in the Final Supplemental EIR have
been reduced to an acceptable level in that:
a. All significant environmental effects that can feasibly be
avoided have been eliminated or substantially lessened as
determined through the findings set forth in paragraph 2.b
of this Resolution;
b. Based upon the Final Supplemental EIR, the documents in the
record, and upon Section III of Attachment "A", specific
economic, social or other considerations make infeasible the
project alternatives identified in said Final Supplemental
EIR;
C. Based upon the Final Supplemental EIR and the documents in
the record, all remaining, unavoidable significant effects of
the proposed development are overridden by the benefits of the
project as described in Section IV of Attachment "A", and the
City Council hereby approved and adopts said Section IV of
said Attachment "A" as a Statement of Overriding Considerations
for the proposed development project and implementing actions.
4. The City Council hereby authorizes and directs that a Notice of
Determination with respect to the Final Supplemental EIR pertain-
ing to the approval of the proposed Disposition and Development
Agreement for the development of the Site, and all other City
Council actions taken in furtherance thereof be filed.
