RESOLUTION NO. 84-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ORDERING THE VACATION OF
SURPLUS CITY RIGHT-OF-iVAY LOCATED BETWEEN TUSTIN
AND IRVINE AVENUES, SOUTH OF 17TH STREET.
WHEREAS, the City Council of the City of Costa Mesa did, on the 19th
day of December, 1983, pass and adopt Resolution No. 83-121, entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS INTENTION TO ORDER THE VACATION OF SURPLUS CITY RIGHT-OF-IWAY
LOCATED BETWEEN TUSTIN AND IRVINE AVENUES, SOUTH OF 17TH STREET"; and
WHEREAS, pursuant to said Resolution of Intention, the time and place
for hearing all persons interested in or objecting to the proposed vaca-
tion was set for Monday, the 16th day of January, 1984, at the hour of
6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa
Mesa, California, and thereafter was continued to Tuesday, the 21st day of
February, 1984, and continued to Monday, May 21, 1984; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section 8300
et seq. of the Streets and Highways Code of the State of California; and
WHEREAS, said date of hearing caning on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing
was closed on the 21st day of May, 1984; and
WHEREAS, the City Council of the City of Costa Mesa finds and deter-
mines, frau all the evidence submitted, that the hereinafter described
right-of-way is unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER
AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right-of-way is unnecessary for
present or prospective street purposes.
2. It is hereby ordered that the following described right-of-way
be, and the same is hereby vacated:
PARCEL 1:
The southwesterly 20.00 feet of the southeasterly 57.21 feet of the
northwesterly 257.21 feet of Lot 87 in Newport Heights tract in the
City of Costa Mesa, as shown on a map recorded in Book 4, Page 83 of
Miscellaneous Maps, records of the County Recorder, Orange County,
California.
PARCEL 2:
The southwesterly 20.00 feet of the southeasterly 107.21 feet of the
northwesterly 414.42 feet of Lot 87 in Newport Heights tract in the
City of Costa Mesa, as shown on a map recorded in Book 4, Page 83 of
Miscellaneous Maps, records of the County Recorder, Orange County,
California.
PARCEL 3:
The southwesterly 20.00 feet of the southeasterly 107.26 feet of
Lot 87 in Newport Heights tract in the City of Costa Mesa, as shown
on a map recorded in Book 4, Page 83 of Miscellaneous Maps, records
of the County Recorder, Orange County, California.
PARCEL 4:
The southwesterly 20.00 feet of the northwesterly 372.00 feet of
Lot 88 in Newport Heights tract in the City of Costa Mesa, as shown
on a map recorded in Book 4, Page 83 of Miscellaneous Maps, records
of the County Recorder, Orange County, California.
RESERVING therefrom an easement for all existing underground and
overhead public utilities together with the right of ingress and
egress for the purpose of maintaining, replacing, and upgrading
said existing public utilities.
ALSO RESERVING therefrom the right of ingress and egress for the
purpose of public access.
All as more particularly shown on a map attached hereto and by this
reference made a part hereof.
