HomeMy WebLinkAbout84-95 - Fees Established to Store Hazardous Materials in Tanks Underground-1.7��3 RESOLUTION NO. 84-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING THE FEE FOR A PERMIT TO STORE HAZARDOUS MATERIALS IN UNDER- GROUND TANKS. WHEREAS, the State of California has recently enacted legislation for the inspection and regulation of the storage of hazardous substances in underground tanks and piping contained in Health and Safety Code Sections 25150.1 and 25280 through 25289; and WHEREAS, Health and Safety Code Section 25282 provides for the City of Costa Mesa to assume exclusive jurisdiction for the purposes of carrying out this legislation; and WHEREAS, the City of Costa Mesa has adopted Ordinance 84-30, imple- menting the provisions of Health and Safety Code Sections 25280 through 25289; and WHEREAS, Health and Safety Code Section 25283.3(a) provides that the City shall establish fees at a level sufficient to pay the necessary and reasonable casts incurred in administering this legislation, including, but not limited to, permit and inspection responsibilities; and WHEREAS, this Council deems it to be in the best interest of the City that fees be established as recommended by the Fire Department of the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that the amount of the fee for a permit to store hazardous materials in an underground tank is hereby established as $110.00 per tank. For a single site which contains more than one tank and for which all applications and information are submitted at the same time, the amount of the fee for a permit to store hazardous materials in an underground tank is hereby established as $110.00 for the first tank and $60.00 per tank for each additional tank. This fee plus any surcharge legislated by the State of California and permit and plan check fees required by the Uniform Build- ing Code, as adopted by the City of Costa Mesa, shall be collected at the time of the application for permit.
