HomeMy WebLinkAbout84-97 - Ordering Vacation - North side of E. 17th Street, Near 124-130 East 17th StreetRecorded July 23, 1984 4:00 p.m. Document No. 84-303138 RESOLUTION NO. 84-97 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE VACATION OF SURPLUS CITY RIGHT-OF-WAY LOCATED ON THE NORTH SIDE OF EAST 17TH STREET, ADJACENT TO 124 AND 130 EAST 17TH STREET. WHEREAS, the City Council of the City of Costa Mesa dial, on the 18th day of Jame, 1984, pass and adopt Resolution No. 84-81, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTEN'T'ION TO ORDER THE VACATION OF SURPLUS CITY RIGHT-OF-WAY LOCATED ON THE NORTH SIDE OF EAST 17TH STREET, ADJACENT To 124 AND 130 EAST 17TH STREET"; and WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vaca- tion was set for Monday, the 16th day of July, 1984, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Section 8300 et seq. of the Streets and Highways Code of the State of California; and WHEREAS, said date of hearing caning on regularly to be heard, all persons appearing on the proposed vacation were heard, and said hearing was closed on the 16th day of July, 1984; and WHEREAS, the City Council of the City of Costa Mesa funds and deter- mines, from all the evidence submitted, that the hereinafter described right-of-way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described right-of-way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right-of-way be, and the same is hereby vacated: PARCEL 1. The southwesterly 10.00 feet of the northwesterly 60.00 feet of the southeasterly 300.00 feet of Lot 91 of Newport Heights Tract as shown in Book 4, Page 83 of Miscellaneous Maps, records of the County Recorder, Orange County, California. PARCEL 2. The southwesterly 10.00 feet of the northwesterly 90.00 feet of the southeasterly 240.00 feet of Lot 91 of Newport Heights Tract as shown in Book 4, Page 83 of Miscellaneous Maps, records of the County Recorder, Orange County, California. RESERVING therefrom an easement for all existing underground and overhead public utilities together with the right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities.
