RESOLUTION NO. 84-127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF SURPLUS CITY RIGHT-OF- WAY ON A PORTION OF STERLING AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa does hereby declare its intention to vacate surplus City right-of-way on a portion of Palace Avenue, described as follows: PARCEL NO. 1: That portion of Block "C" of Tract No. 612 in the City of Costa Mesa, County of Orange, State of California, as shown on a map thereof, recorded in Book 20, pages 1 and 2 of Miscellaneous Maps, Records of Orange County, described as follows: The Easterly 20.00 feet of Lots 14, 17, and 18, and the Easterly 17.00 feet of the Westerly 20.00 feet of Lots 33, 34, 36, 37, 38, and 39, all of said Block "C" of Tract No. 612. PARCEL NO. 2: That portion of Lot 40, Block "C" of Tract No. 612 in the City of Costa Mesa, County of Orange, State of California, as shown on a map thereof, recorded in Book 20, pages 1 and 2 of Miscellaneous Maps, Records of Orange County, described as follows: The Easterly 17.00 feet of the Westerly 20.00 feet of said Lots 40, together with a corner cut off bounded by the Easterly line of said Easterly 17.00 feet and a line 30.00 feet Northerly of and parallel to the centerline of Twentieth Street (60.00 feet wide) and a curve concave Northeasterly having a radius of 15.00 feet, said curve being tangent to each of the above referenced sidelines. EXCEPTING THERE- FROM the Southerly 5.00 feet of said Lot 40. PARCEL NO. 3: That portion of Block "F" of Tract No. 612 in the City of Costa Mesa, County of Orange, State of California, as shown on a map thereof, recorded in Book 20, pages 1 and 2 of Miscellaneous Maps, Records of Orange County, described as follows: The Easterly 20.00 feet of Lots 4, 6, 7, 8, 9, 10, 12, 13, 16 and 17, and the Easterly 17.00 feet of the Westerly 20.00 feet of Lots 22, 24, 25, 26, 27, 28, 29, 30, 32, 33, 35 and 36, all in said Block "F" of Tract No. 612. PARCEL NO. 4 That portion of Lot 21, Block "F" of Tract No. 612 in the City of Costa Mesa, County of Orange, State of California, as showwn on a map thereof, recorded in Book 20, pages 1 and 2 of Miscellaneous Maps, Records of Orange County, described as follows: The Easterly 17.00 feet of the Westerly 20.00 feet of said Lot 21, together with a corner cut off bounded by the Easterly line of said Easterly 17.00 feet and a line 30.00 feet Southerly of and parallel to the centerline of Twentieth Street (60.00 feet wide) and a curve concave Southeasterly having a radius of 15.00 feet, said curve being tangent to each of the above referenced sidelines. EXCEPTING THEREFROM the Northerly 5.00 feet of said Lot 21. RESERVING therefrom an easement for all existing underground and overhead public utilities together with the right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities. SECTION 2. Monday, the 3rd day of December, 1984, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to the proposed vacation. SECTION 3. 'These proceedings shall be conducted pursuant to the provisions of Section 8300 et seq. of the Streets and Highways Code of the State of California. SECTION 4. The City Manager of the City of Costa Mesa is hereby directed to cause notices of the said proposed vacation to be conspicuously posted along said strips of land for at least ten (10) days before the date of said hearing. Said notices shall be posted not more than three hundred (300) feet apart, but in no event shall less than three (3) notices be posted. SECTION 5. This Resolution shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, Orange County, California.
