RESOLUTION NO. 84-144
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, FINDING AND DETERMINING
THAT A PORTION OF PUBLIC PROPERTY NOW DEVOTED TO
PUBLIC PARKING PURPOSES IS NOT NEEDED FOR THAT
PUBLIC USE, AND DEVOTING SUCH PROPERTY TO ANOTHER
PUBLIC USE.
WHEREAS, the City of Costa Mesa owns certain public property consist-
ing
onsisting of .30 acres, which is intended for use as public parking places
(herein "public property") , and the City determines that said public
property is not needed for such public purpose, and it intends to devote
said public property to another public use, to wit: redevelopment purposes;
and
WHEREAS, the public property is adjacent to other vacant, unimproved
public property owned by the Costa Mesa Redevelopment Agency also near
property now being condemned and acquired by the Costa Mesa redevelopment
Agency for redevelopment purposes, a public use and purpose, and all said
Redevelopment Agency property is a part of the Costa Masa Courtyards Down-
town Redevelopment Project (herein "Courtyards Project"), which project
will include public parking; and
WHEREAS, the change of public use and purpose of the City -owned
property will be of general benefit to the area canprising Vehicle Parking
District Number One and the Costa Mesa Downtown redevelopment Area; and
WHEREAS, pursuant to and in compliance with Streets and Highways Code
Section 31851.5 and Government Code Section 6061, notice of the public
hearing on a Resolution of Determination was duly published in a newspaper
circulated in the City of Costa Mesa, to wit: The Daily Pilot; and
WHEREAS, pursuant to and in compliance with Streets and Highways Code
Section 31851.5, the City Council of the City of Costa Mesa has held a
public hearing relating to said resolution of Determination;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Costa Mesa does hereby find, declare, and determine that the public
property, a portion of certain real property now owned by the City of Costa
Masa and intended for use as public parking places, is not needed for that
public use; and
BE IT FURTHER RESOLVED, that the public property is hereinafter
legally described in the incorporated and attached Exhibit "A'; and
BE IT FURTHER RESOLVED, that pursuant to Streets and Highways Code
Section 31851.5, that public property may be devoted to same other public
use; and
BE IT FURTHER RESOLVED, that the City Council of the City of Costa
Mesa does hereby determine and find that public property will now be
devoted to redevelopment uses, a public purpose and use, and that the
redevelopment use is and will be of generel benefit to the area canprising
W hicle Parking District Number One and the Costa Mesa Downtown redevelop-
ment Area, and that the public property will be included in the Costa Mesa
Courtyards Project; and
BE IT FURTHER RESOLVED, that because said public property by this
resolution will be devoted to redevelopment use, and because the City of
Costa Mesa has and will receive valuable consideration and public benefits
fram the Courtyards Project and frau the public improvements and facilities
to be constructed with and as a part of the Courtyards Project, the City
Council of the City of Costa Mesa hereby authorizes, empowers and directs
the conveyance of said public property to the Costa Mesa Redevelopment
Agency in fee for purposes consistent with redevelopment as such redevelop-
ment purposes are set forth in Health and Safety Code Section 33000, et
seq.; and
BE IT FURTHER RESOLVED, the Mayor of the City of Costa Mesa is
authorized to execute a grant deed for the conveyance of the public
property to the Costa Mesa Fedeveloprient Agency in fee, and to take all
other actions necessary and/or incidental thereto to devote and convey said
public property to redevelopment uses.

That portion of Block "C", Tract No. 18, in the City of Costa Mesa,
County of Orange, State of California, as shown on the map filed in
Book 9, Page 20 of Miscellaneous Maps, BL -cords of said County, described
as follows:
The east 66 feet of Lot 18 of said Block "C", excepting therefrcan
the northerly 200 feet thereof;
Also the vast 44 feet of Lot .17 of said Block "C", excepting there-
from the northerly 150 feet thereof;
Also that portion of Lot 30 of said Block "C" lying northeasterly
of the northwesterly prolongation of the southvesterly line of
Lot 9 of said Block "C".
