HomeMy WebLinkAbout85-51 - Underground Utility District 17room RESOLUTION NO. 85-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NUMBER 17 ON FAIR DRIVE FROM FAIRVIEW ROAD TO NEWPORT BOULEVARD AND DEL MAR AVENUE, AND FROM NEWPORT BOULEVARD TO 350 FEET EAST OF ELDEN AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, a public hearing was called for June 3, 1985, at the hour of 6:30 p.m., in the Council Chambers of City Hall, Costa Mesa, California, to ascertain whether the public necessity, health, or welfare requires the underground installation of wires and facilities for supplying electrical, camtnunication, or similar or associated service, within that certain area of Costa Mesa described as follows: BEGINNING at the centerline intersection of Fair Drive and Fairview Iniad as it is shown on a map recorded in Book 94, Page 1 of Records of Surveys of the County Ibcorder of Orange County, California; thence northerly along the centerline of Fairview Road a distance of 80.00 feet; thence easterly along a line parallel with and distant 80.00 feet northerly of the centerline of Fair Drive a distance of 2392.75+ feet to the beginning of a tangent curve concave southwesterly and having a radius of 1080.00 -feet, said curve being concentric with the centerline of Fair Drive; thence southeasterly along said tangent curve through a central angle of 40017145" an arc distance of 759.56 feet; thence southeasterly 246.68+ feet to a point on the centerline of Newport Boulevard, said point being 80.00 feet northeasterly, measured along the centerline of Newport Boulevard, from the center- line intersection of Del Mar Avenue and Newport Boulevard as it is shown on a map recorded in Book 539, Pages 30 and 31 of Miscellaneous Maps, Records of the County Recorder of said County; thence north- easterly along the centerline of Newport Boulevard a distance of 70.00 feet; thence southeasterly along a line parallel with and dis- tant 150.00 feet northeasterly of the centerline of Del Mar Avenue a distance of 1010.30+ feet to a point on a line parallel with and dis- tant 350.00 feet southeasterly of the centerline of Elden Avenue, as said centerline is shown on that aforementioned map recorded in Book 539, Pages 30 and 31; thence southwesterly along said parallel line to a point on a line parallel and distant 80.00 feet southwesterly of the centerline of Del Mar Avenue; thence northwesterly along last said parallel line to a point on a line parallel with and distant 170.00 feet southeasterly of the centerline of Newport Boulevard; thence continuing southwesterly parallel with Newport Boulevard to a point on a line parallel with and distant 290.00 feet southwesterly of the centerline of Del Mar Avenue; thence northwesterly along last said parallel line to the beginning of a tangent curve concave southwest- erly outhwesterly and having a radius of 710.00 feet, said curve being concentric with the centerline of Fair Drive; thence northwesterly along said tangent curve through a central angle of 40017145" an arc distance of 499.34 feet; thence northerly along a radial line to a point on a line parallel with and distant 70.00 feet southerly of the centerline of Fair Drive; thence westerly along last said parallel line a dis- tance of 2392.75+ to a point on the centerline of Fairview Fbad, said point being 70.00 feet southerly, measured along the centerline of Fairview Road, of the point of beginning, thence northerly along the centerline of Fairview Fuad to the POINT OF BEGINNING. All as more particularly shown on the map attached hereto and made a part hereof. WHEREAS, notice of such hearing has been given to all affected prop- erty owners as such shown on the last equalized assessment roll and to all utilities concerned in the manner and time required by law; and 82. WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa, that pursuant to Title 13, Chapter VIII, Sections 13-684 through 13-700, Costa Mesa Municipal Code, the above described area is hereby declared an Underground Utility District and is designated as Underground Utility District No. 17 of the City of Costa Mesa. Attached hereto marked Exhibit "A" and hereby incorporated as a part of this Resolution is a map delineating the boundaries of said District. BE IT FURTHER RESOLVED that the Council does hereby fix November 1, 1987, as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires, and associated overhead structures, and the under- ground installation of wires and facilities for supplying electrical, canmunication, or similar or associated service within Underground Utility District No. 17 on December 31, 1987. BE IT FURTHER RESOLVED that the following exception in said Under- ground Utility District No. 17 be, and they are hereby authorized: (1) Any Municipal facilities or equipment installed under the super- vision and to the satisfaction of the City Engineer. (2) Poles or electroliers used exclusively for street lighting (or traffic signals) . (3) Overhead wires (exclusive of supporting structures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to a building on the perimeter of a District, when such wires originate in an area frau which poles, overhead wires, and associated overhead structures are not pro- hibited. (4) Antennae, associated equipment, and supporting structures, used by a utility for furnishing camiunication services. (5). Equipment appurtenant to underground facilities such as surface - mounted transformers, pedestal -mounted terminal boxes and meter cabinets, and concealed ducts. (6) Temporary poles, overhead wires, and associated overhead struc- tures used or to be used in conjunction with construction projects. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 17 of the adoption of this Resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they, or any person occupying such property desires to continue to receive elec- tric, canmunication, or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such frau the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations, and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said Sections 13-684 through 13-700 of the Costa Mesa Municipal Code, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FINALLY RESOLVED that the City Council hereby finds and deter- mines as follows: The Underground Utility District herein created is in the general public interest for the following reasons: (1) The undergrounding will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. (2) The streets and rights of way in the District are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic.
