HomeMy WebLinkAbout85-30 - Declaring 350 Hanover Drive Surplus Porperty and Call for Bids10 RESOLUTION NO. 85-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING 350 HANOVER DRIVE, COSTA MESA, AS SURPLUS PROPERTY, DECLAR- ING ITS INTENTION TO DISPOSE OF SAID SURPLUS REAL PROPERTY, SETTING THIS DATE AS THE TIME FOR HEAR- ING PROTESTS TO SAID DISPOSITION, DESCRIBING THE LAND TO BE DISPOSED, SETTING FORIH IN GENERAL TERMS THE INTEREST, EASEMENTS OR RESERVATIONS TO BE RESERVED BY THE PUBLIC; SETTING THE TIME AND PLACE OF THE SALE; ESTABLISHING TERMS AND CONDI- TIONS OF THE SALE AND CALLING FOR SEALED BIDS IN WRITING. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, AiEREAS, legal authority exists for a municipal corporation to sell or dispose of surplus land and impravements for the camion benefit per Government Code Sections 37350 and 37351; and WiEREAS, the subject land and improvements, as more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, are found to be surplus real property and this method of sale and disposition is for the common benefit; and WiEREAS, said lands are further described in a plat marked Exhibit "B" attached to this Resolution and by this specific reference made a part hereof; and WiEREAS, City desires to dispose of said lands to the highest bidder. NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid author- ity, the City does hereby offer for sale the real property described in Exhibit "A" attached hereto, and as more particularly described in the plat marked Exhibit "B" attached hereto. BE IT FURTHER RESOLVED that said sale shall be in accordance with the ten -ns and conditions as set forth in the Notice of Sale at Public Auction attached to this Resolution marked Exhibit "C" and to the Condition of the Title described in Exhibit "D" by this specific reference made a part hereof. BE IT FURTHER RESOLVED that a Notice of Sale be published in the Orange Coast Daily Pilot at least once within ten (10) days prior to the date set for bid opening herein. BE IT FURTHER RESOLVED that all bids shall be filed with the City Clerk of the City of Costa Mesa on or before 11:00 a.m. on the 17th day of May, 1985. BE IT FINALLY RESOLVED that the opening of said bids shall take place at the hour of 11:00 a.m. in the City Council Chambers of the City of Costa Mesa, 77 Fair Drive, Costa Mesa, California, on the 17th day of May, 1985. Except therefran all oil, minerals, gas, asphaltum, brea and other hydro- carbon substances in and under said land below 500 feet from the surface thereof, as reserved by George H. EXHIBIT "C' NOTICE OF SALE AT PUBLIC AUCTION WHAT: Public sale of an Rl zoned parcel of land containing approximately 9,324 square feet, located at 350 Hanover Drive, Costa Mesa ( see attached map marked Exhibit "B") , which is improved with a singlestory, three-bedroan, two -bath residence. WHEN: 11:00 a.m., Friday, May 17, 1985 TERMS: Minimum Bid: $125,000.00 Bidder's Deposit: A Bidder's Deposit in the amount of $12,500.00 and in the form of a Cashier's Check must be submitted with the written bid or prior to oral bidding if no written bid is submitted. If your offer is accepted, the Bidder's Deposit will be applied to the down payment. Deposits of the unsuccess- ful bidders will be refunded. The Cashier's Check should be made payable to the City of Costa Mesa. Down Payment: Twenty percent (20%) of the total amount bid must be paid within seven (7) days of May 17, 1985, by the bidder who has been notified that he is the apparent qualified high bidder. Written Bids: The written bids must be submitted on the following special forms. No written bids will be received after May 17, 1985, 11:00 a.m. Oral Bids: Oral bids will be taken after all written bids have been opened and read. The first oral bid must exceed the highest written bid by at least l%. No person will be allowed to participate in oral bidding unless he has posted the required Bidder's Deposit.
