A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, AUTHORIZING RECORDS
DESTRUCTION FOR THE POLICE DEPARTMENT, OF THE
CITY OF COSTA MESA, PURSUANT TO ORDINANCE
NO. 75-60.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, the City Council has adopted Ordinance No. 75-60 on
the 15th day of January, 1975, which said Ordinance requires the approval
of the City Council by Resolution for the destruction of certain records;
and
WHEREAS, the City Attorney's Office, pursuant to the requirements of
the Government Code, has examined said records to ascertain whether or not
the retention is legally necessary; and
WHEREAS, the City Attorney's Office has determined that the destruc-
tion of said records will not adversely affect the functions of government
nor impair the legal rights of the City;
NOW, THEREFORE, BE IT RESOLVED that those records listed on the
attached request for record destruction for the Police Department, are
hereby authorized to be destroyed in such a manner that will not allow
them to be restored or reconstituted.
PASSED AND ADOPTED this 18th day of November, 1985.

AUTHORITY: Government Code Section 34090
In accordance with Government Code Section 34090, the Police Department
may destroy certain records retained in its files. The destruction of
these records require the approval of the City Attorney and subsequent
approval and authorization of the City Council through a resolution.
Your review and concurrence with the attached report and resolution
for City Council approval will be appreciated.

Sir:
Attached are reports reference the destruction of certain archive records
now retained by this Department.
Should you concur with the recommendations, the following procedure is
recommended:
1. Concurrence from Captains Moody and Green.
2. Concurrence from the Chief of Police.
3. The Chief's office forward a memorandum to the City Attorney
for approval.
4. Presentation of the study and resolution to the City Council
by the appropriate delegate.
Since the resolution and supporting documents are in original form and
intended for possible council presentation, I respectfully request that
you hand carry or refer same to myself for hand carrying to the required
individuals.
