WHEREAS, the City Council of the City of Costa Mesa did, on the 16th day of December, 1985, pass and adopt Resolution No. 85-106, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF EXCESS CITY RIGHT-OF-WAY ON HARBOR AND NEWPORT BOULEVARDS AT THE COURTYARDS"; WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 6th day of January, 1986, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Section 8300 et seq. of the Streets and Highways Code of the State of California; and WHEREAS, said date of hearing coming on regularly to be heard, all persons appearing on the proposed vacation were heard, and said hearing was closed on the 6th day of January, 1986; and WHEREAS, the City Council of the City of Costa Mesa finds and deter- mines from all the evidence submitted that the hereinafter described right- of-way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described right-of-way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right-of-way be, and the same is hereby vacated: PARCEL 1 Beginning at the most southwesterly corner of Parcel 1 of Parcel Map No. 84-376, filed in Book 196, Page 1 through 3 inclusive of Parcel Maps, records of the County Recorder, Orange County, California; thence south 89038116" east 5.00 feet to the easterly line of Park Avenue; thence north 00020153" east 566.29 feet; thence leaving said easterly line north 45020126" east 39.59 feet to the southerly line of Nineteenth Street as shown on said Parcel Map; thence along said southerly line south 89040101" east 375.81 feet to the beginning of a tangent curve concave southwesterly having a radius of 58.00 feet; thence continuing along said southerly line, southeasterly 22.90 feet along said curve through a central angle of 22137112" to the begin- ning of a reverse curve concave northeasterly having a radius of 72.00 feet; thence continuing along said southerly line, southeasterly 28.43 feet along said curve through a central angle of 22037112" to the beginning of a reverse curve concave northeasterly having a radius of 72.00 feet; thence continuing along said southerly line, southeasterly 28.43 feet along said curve through a central angle of 22037112"; thence south 89040101" east 10.00 feet to the beginning of a tangent curve concave northerly having a radius of 1437.00 feet; thence con- tinuing along said southerly line, easterly 81.88 feet along said curve through a central angle of 03115154" to a non -tangent point which bears a radial bearing of north 03035152" east; thence leaving said southerly line, south 42059150" east 38.29 feet to the westerly line of Harbor Boulevard as shown on last mentioned parcel map; thence along said westerly line, south 00022112" west 294.09 feet to an angle point of said westerly line; thence continuing on said westerly line, south 45022112" west 25.46 feet; thence south 00022112" west 50.00 feet; thence south 89°37148" east 11.00 feet; thence south 44037'48" east 14.15 feet to the easterly line of Parcel 1 of said Parcel Map; thence along said easterly line north 00122112" east 135.66 feet; thence continuing along said easterly line south 89137148" east 5.00 feet; thence continuing along said easterly line north 00022112" east 287.69 feet to the beginning of a tangent curve concave northeasterly having a radius of 15.00 feet; thence northwesterly and westerly 23.57 feet along said curve through a central angle of 90°02'13" to the northerly line of Parcel 1 as shown on said Parcel Map; thence along said northerly line, north 89140101" west 555.01 feet to the beginning of a tangent curve concave northwesterly having a radius of 15.00 feet; thence southwesterly and southerly 23.56 feet along said curve through a central angle of 89159'06" to the westerly line of Parcel Map; thence along said westerly line south 00120153" west 605.28 feet to the Point of Beginning. PARCEL 3 Camnencing at the most southerly corner of Parcel 1 of Parcel Map No. 84-388, filed in Book 197, Pages 48 and 49 inclusive of Parcel Maps, records of the County Recorder, Orange County, California; thence north 49119'32" west 8.00 feet to the True Point of Beginning; thence north 40138143" east 77.50 feet; thence north 04021117" west 2.82 feet; thence south 40038143" west 79.50 feet to the southerly line of said Parcel 1; thence south 49119132" east 2.00 feet to the True Point of Beginning. RESERVING therefrom an easement for all existing underground and over- head public utilities together with the right of ingress and egress for the purpose of maintaining, replacing, and upgrading said existing public utilities. All as more particularly shown on a map attached hereto and by this reference made a part hereof.
