HomeMy WebLinkAbout87-02 - Discretionary Powers for Leisure Services & Public Services DirectorsRESOLUTION NO. 87-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING AND APPOINT- ING THE DIRECTOR OF PUBLIC SERVICES AND THE DIRECTOR OF LEISURE SERVICES TO EXERCISE DISCRE- TIONARY POWERS. WHEREAS, it has been the custom and practice of the City of Costa Mesa to have the Director of Public Services and the Director of Leisure Serv- ices, and other persons acting under their supervision, review and approve plans and designs for public improvements within their respective areas of responsibility, rather than having the City Council approve each such plan and design; and WHEREAS, the Director of Public Services and the Director of Leisure Services have the training and experience that qualify them to perform this discretionary function and to assess the qualifications of other persons to perform such function; and WHEREAS, it does not appear from the City archives that there has been a formal delegation of this authority from the City Council to the Director of Leisure Services; and WHEREAS, Government Code Section 830.6 appears to require such a dele- gation in order to establish design immunity for public improvements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that the Director of Public Services and the Director of Leisure Services are hereby authorized and appointed to exercise discretionary authority to review and approve plans and designs for construction, modifi- cation, and repair of improvements to public property of the City of Costa Mesa within their respective areas of responsibility, and to promulgate standards for such plans and designs. The Director of Public Services and the Director of Leisure Services may delegate authority to review and approve such plans and designs to appropriate employees of the City of Costa Mesa acting under their general supervision. BE IT FURTHER RESOLVED that the City Council of the City of Costa Mesa does hereby ratify and approve retroactively all prior approvals by the Director of Public Services and the Director of Leisure Services of plans and designs for improvements to public property of the City of Costa Mesa.
