A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ODSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF NEWPORT
BOULEVARD AT THE COSTA MESA ODURTYARDS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa does hereby
declare its intention to vacate a portion of Newport Boulevard at the Costa
Mesa Courtyards, more particularly described as follows:
Land described herein is within the City of Costa Mesa, County of
Orange, State of California, being those portions of Parcel 1 of
Parcel Map No. 84-388, filed in Book 197, Pages 48 and 49 inclusive of
Parcel Maps, records of said County described as follows:
Commencing at the most southerly corner of Parcel 1 of said Parcel
Map; thence north 49°19'32" west, 6.33 feet to the True Point of
Beginning; thence north 40°38'43" east, 75.83 feet; thence north
4121117" west, 2.36 feet to the southeasterly line of that certain
document recorded January 8, 1986, as Instrument No. 86-008803; thence
along said southeasterly line south 4003843" west, 77.50 feet to the
southerly line of said Parcel 1; thence south 49019132" east, 1.67
feet to the True Point of Beginning.
RESERVING therefrom a surface easement for pedestrian and appurtenant
purposes.
ALSO RESERVING therefrom an easement for all existing underground and
overhead public utilities together with the right of ingress and
egress for the purpose of maintaining, replacing, and upgrading said
existing public utilities.
SECTION 2. Monday, the 1st day of June, 1987, at 6:30 p.m., in the
Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California, is
hereby fixed as the time and place for hearing all persons interested in or
objecting to the proposed vacation.
SECTION 3. These proceedings shall be conducted pursuant to the
provisions of Section 8300 et seq. of the Streets and Highways Code of the
State of California.
SECTION 4. The City Manager of the City of Costa Mesa is hereby
directed to cause notices of the said proposed vacation to be conspicuously
posted along said strips of land for at least ten (10) days before the date
of said hearing. Said notices shall be posted not more than three hundred
(300) feet apart, but in no event shall less than three (3) notices be
posted.
SECTION 5. This Resolution shall be published once in the ORANGE
COAST DAILY PILOT, a newspaper of general circulation printed and published
in the City of Costa Mesa, Orange County, California.
PASSED AND ADOPTED this 4th day of May, 1987.
