A RESOLUTION CF THE CITY ODUNCIL CF THE CITY OF
OOSTA MESA, CALIFORNIA, DECLARING 2605 4ESI4INSTER
PLACE AS SURPLUS PROPERTY, DECLARING ITS INTENTION
TO DISPOSE CF SAID SURPLLS REAL PROPERTY, SETTING
THIS DNTE AS THE TIME FCR HEARING PROTESTS TO SAID
DISPOSITION, DESCRIBING THE LAND TO BE DISPOSED,
SETTING FORTH IN GENERAL TERMS THE INTEREST, EASE-
MENTS, OR RESERVATIONS TO BE PRESERVED BY THE
PUBLIC; SETTING THE TIME AND PLACE CF THE SALE;
ESTABLISHING TENS AND CONDITIONS CF THE SALE, AND
CALLING FOR SEALED BIE3 IN WRITING.
THE CITY COUNCIL CF THE CITY CF COSTA MESA DOES HEREBY RESOLVE AS
ROLLOYU :
THAT, MEREAS, legal authority exists for a municipal corporation to
sell or dispose of surplus land and improvements for the camron benefit per
Government Code Sections 37350 arra 37351; and
MEREAS, the subject land, as more particularly described in Exhibit
"A', attached hereto arra incorporated herein by reference, is found to be
surplus real property and this method of sale and disposition is for the
comrmn benef it; and
WHEREAS, said land is further described in a plat marked Exhibit "B"
attached to this Resolution and by this specific reference made a part
hereof ; and
WHEREAS, the land will be of fered to public agencies as required by
the provisions of Government Code Section 54222, and if none of those
agencies indicates within 60 days that it intends to accept the offer, the
land will then become available for public sale; and
WHEREAS, City desires to dispose of said land to the highest bidder;
NOW, THEREFORE, 12E IT RESOLVED that pursuant to the aforesaid author-
ity, the City does hereby offer for sale the real property described in
Exhibit "A" attached hereto, arra as nDre particularly described in the plat
marked Exhibit "B" attached hereto.
BE IT FURTHER RESOLVED that said sale shall be in accordance with the
tenors and conditions as set forth in the Notice of Sale at Public Auction
attached to this Resolution marked Exhibit "C" and to the Condition of the
Title described in Exhibit "L1' by this specific reference made a part
herecf .
BE IT FURTHER RESOLVED that a Notice of Sale shall be published in the
Orange Coast Lily Pilot at least once within ten (10) days prior to the
date set for bid cpening herein.
BE IT FURTHER RESOLVED that all bids shall be filed with the City
Clerk for the City of Costa Mesa on or before 11:00 a.m. on the 15th day
of April, 1988.
BE IT FINALLY RESOLVED that the opening of said bids shall take place
at the hour of 11:00 a.m. in the City Council Chambers of the City Council
of the City of Costa Mesa, 77 Fair Drive, Costa Mesa, California, on the
15th day of April, 1988.

NOTICE OF SALE AT PUBLIC AUCTION
WHAT: Public sale of an R1 zoned parcel of land containing
approximately 8,400 square fleet, located at 2605
Westminster Place, Costa Mesa, (see attached map
marked Exhibit "A"), vhich is unimproved. Zb be
sold as is.
WHEN: 11:00 a.m., Friday, April 15, 1988

Minimum Bid: $115,000.00
Bidder's Deposit: A Bidder's Deposit in the amount of $11,500.00 arra in
the form of a Cashier's Check must be submitted with
the written bid or prior to oral bidding if no writ-
ten
ritten bid is submitted.
If pur offer is accepted, the Bidder's Deposit will
be applied to the down payment. Deposits of the
unsuccessful bidders will be refunded.
The Cashier's Check should be made payable to the
City of Costa Mesa.
Down Payment: Twenty percent (20%) of the total amount bid mast be
paid within seven (7) days of April 15, 1988, by the
bidder who has been notified that he is the apparent
qualified high bidder.
Balance of Payment: The successful bidder will pay the balance of the
purchase price within ninety (90) days after the
City Council executes the sales contract.
Rejection: Seller reserves the right to reject all bids.

Written Bids: The written bids must be submitted on the following
special forms. No written bids will be received
after April 15, 1988, 11:00 a.m.
Oral Bids: Oral bids will be taken after all written bids have
been opened and read. The first oral bid must
exceed the highest written bid by at least one per-
cent (A) . No person will be allowed to participate
in oral bidding unless he has posted the required
Bidder's Deposit. Each successive oral bid will be
a minimum of $1,000 increments.

60 feet of frontage on Westminster Place.

(ONDITION CP TITLE:
1. General and special taxes fior the fiscal year 1987-88, a lien not yet
payable.
2. The lien of supplemental taxes assessed pursuant to Chapter 3.5 can-
nencing with Section 75 cf the CalifDrnia Revenue and Taxation Code.
3. Covenants, conditions, and restrictions in an instrument recorded in
Bock 437, Page 231 of Deeds, which provide that a violation thereof
shall not defeat or reader invalid the lien cf any mortgage or deed of
trust made in good faith and fnr value, but deleting restrictions, if
any, based on race, color, religion, or national origin.
