HomeMy WebLinkAbout88-54 - Certifying EIR No. 1038 for PA-88-40, T-13224, & ZE-83-111ARESOLUTION NO. 88-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA CERTIFYING FINAL ENVIRON- MENTAL IMPACT REORT NO. 1038 AS COMPLETE AND ADEQUATE FOR A PLANNED DEVELOPMENT (PLANNING ACTION PA -88-40), VESTING TENTATIVE MAP T-13224; AND AN AMENDMENT TO A CONDITIONAL USE PERMIT (ZONE EXCEPTION ZE-83-111A). WHEREAS, the Draft Environmental Impact Report No. 1038 (State Clear- inghouse Number 87122314) provided environmental impact assessment for a Planned Development, a Vesting Tentative Map and an Amendment to a Condi- tional Use Permit; and WHEREAS, the Draft Environmental Impact Report was prepared in accord- ance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City of Costa Mesa Environmental guidelines; and WHEREAS, the Draft Environmental Impact Report was circulated to the public for comment and review; and WHEREAS, written comments were received from the public during and after the review period; and WHEREAS, the Costa Mesa Planning Commission conducted a public hearing to receive public testimony with respect to the DEIR; and WHEREAS, such comments and testimony were responded to through Response to Comments and staff reports submitted to the Planning Commission and City Council; and WHEREAS, comments and testimony were fully and adequately responded to in the manner set forth in California Administrative Code Section 15088(b); and WHEREAS, the Costa Mesa Planning Commission has reviewed all environ- mental documents comprising the Environmental Impact Report (EIR) and has found that the EIR considers all environmental impacts of the proposed Planned Development (Planning Action PA -88-40), the Vesting Tentative Tract Map (T-13224) and the Amendment to the Conditional Use Permit (Zone Excep- tion ZE-83-111A) and is complete and adequate and fully complies with all requirements of CEQA and the CEQA Guidelines; and WHEREAS, the City Council of the City of Costa Mesa has reviewed all environmental documentation prepared to evaluate the proposed project, including all elements of the Final EIR and the recommendation of the Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby certify Final Environmental Impact Report No. 1038 as complete and adequate in that it addresses all environmental effects of the proposed project and fully complies with the requirements of the Cali- fornia Environmental Quality Act and the State CEQA Guidelines. Said Final Environmental Impact Report shall be conprised of the following elements: 1. Draft EIR and Technical Appendices 2. Responses to Comments and Revised Summary of Mitigation Measures 3. Planning Commission Staff Reports 4. Planning Commission Minutes 5. Planning Commission Resolution arra Recommendation 6. City Council Staff Reports 7. City Council Minutes 8. City Council Resolution All of the above information shall be on file with the Planning Divi- sion, City of Costa Mesa, City Hall, 77 Fair Dive, Costa Mesa, California 92628-1200.
