A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DIRECTING THAT TWO REFER-
ENDUM PETITIONS BE PLACED ON THE BALLOT FOR THE
NOVEMBER 8, 1988, GENERAL MUNICIPAL ELECTION.
A. WHEREAS, the City Council has called and given notice for a regu-
lar Municipal Election to be held on November 8, 1988; and
B. WHEREAS, a referendum petition on City Council Resolution No.
88-11 and a second referendum on City Council Resolution No. 88-44 have
been certified as having sufficient signatures to qualify for placing on
the ballot for voter consideration; and
C. WHEREAS, the legality of placing these referenda on the ballot
is being challenged in a pending lawsuit entitled, Costa Mesa Residents
for Responsible Growth v. City of Costa Mesa, OCSC Case No. 52-54-40; and
D. WHEREAS, the City Council chooses to revise the ballot descrip-
tion for the second referendum that was used in Resolution No. 88-58 to be
as appears herein;
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
resolve, declare, determine, and order as follows:
1. The following measures are to appear on the ballot for the Novem-
ber 8, 1988, election:
MEASURE "H"
REFERENDUM ON SEGERSTROM HOME RANCH GENERAL PLAN AMENDMENT NO. 1.
Shall City Council Resolution No. 88-11 be adopted which amends the
City's General Plan by (a) setting a 3.100 million square foot maximum
building density for the Segerstran Home Ranch property; (b) setting
the maximum building height at 11 stories for the north half of the
property; (c) setting the maximum building heights at 5 to 20 stories
for the south half of the property; (d) requiring certain corres-
ponding street improvements be added to the Master Plan of Highways;
(e) establishing a funding program to pay for these traffic improve-
ments; and (f) making related changes including setting building
intensity maximums for property in North Costa Mesa?
MEASURE "I"
REFERENDUM ON SEGERSTROM HOME RANCH GENERAL PLAN AMENDMENT NO. 2.
Shall City Council Resolution No. 88-44 be adopted which amends the
City's General Plan by (a) setting a 2.179 million square foot maximum
building intensity for the Segerstram Hone Ranch property; (b) setting
the maximum building height at 4 stories for the north half of the
property; (c) setting the maximum building heights at 5 to 20 stories
for the south half of the property; (d) requiring certain correspond-
ing street improvements be added to the Master Plan of Highways; (e)
establishing a funding program to pay for these traffic improvements;
and (f) making related changes including setting building intensity
maximums for property in North Costa Mesa?
2. Notwithstanding Paragraph 1 above, if the Orange County Superior
Court rules that one or both of these referenda is illegal or for any
reason should not be placed on the ballot, then that referendum or refer-
enda shall not be placed on the ballot.
PASSED AND ADOPTED this 15th day of August, 1988.
