A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND
UTILITY DISTRICT NUMBER 18, BEAR STREET FROM
INTERSTATE 405 FREEWAY TO PAULARINO AVENUE, AND
PAULARINO AVENUE FROM BEAR STREET TO APPROXIMATELY
400 FEET EASTERLY.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, a public hearing was called for August 15, 1988, at the hour
of 6:30 p.m., in the Council Chambers of City Hall, Costa Mesa, California,
to ascertain whether the public necessity, health, or welfare requires the
underground installation of wires and facilities for supplying electrical,
communication, or similar or associated service, within that certain area
of Costa Mesa described as follows:
Those portions of Lots 1 and 2 in Block "C" of the Berry Tract,
together with the undesignated strip of the northerly side thereof,
as shown on a map recorded in Book 9, Page 6 of Miscellaneous Records
of Los Angeles County, California, described as follows:
The westerly and easterly lines of Bear Street, from the northerly
line of said undesignated strip of the northerly side thereof and its
westerly prolongation, to their intersection with the northerly line
of Yukon Avenue on the west and the northerly line of Paularino Avenue
on the east, as referenced in the following deeds and relinguishment,
all as recorded in the office of the County Recorder of Orange County,
California:
City of Costa Mesa Deed No. 2460, Book 11675, Pages 1567 and 1568;
City of Costa Mesa Deed No. 2291, Book 10999, Pages 546 to 549 inclu-
sive; City of Costa Mesa Deed No. 2560, Book 7444, Pages 322 to 324
inclusive; City of Costa Mesa Deed No. 2259, Book 8533, Pages 858 to
860 inclusive; City of Costa Mesa Deed No. 2258, Book 7507, Pages 194
to 197 inclusive; and Parcel 3, as shown on a map of Relinguishm►ent
No. 641, State of California to the City of Costa Mesa, recorded in
Book 8863, Pages 963 and 964.
Excepting therefrcm those portions as described in Resolution No.
76-130 of the City Council of the City of Costa Mesa (not recorded).
The northeasterly and southwesterly lines of Yukon Avenue, as shown
on a map of Tract No. 10513, Book 448, Pages 45 to 47 inclusive of
Miscellaneous Maps, Records of Orange County, California, frau the
centerline intersection of Bear Street and said Yukon Avenue to 100.00
feet northwesterly.
The northeasterly and southwesterly lines of Paularino Avenue, as
currently aligned, frau the centerline intersection of Bear Street and
said Paularino Avenue to 400.00 feet southeasterly.
All as more particularly shown on the map attached hereto and made a
part hereof.
WHEREAS, notice of such hearing has been given to all affected prop-
erty owners as such shown on the last equalized assessment roll and to all
utilities concerned in the manner and time required by law; and
WHEREAS, such hearing has been duly and regularly held and all persons
interested have been given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa, that pursuant to Title 13, Chapter VIII, Sections 13-684 through
13-700, Costa Mesa Municipal Code, the above described area is hereby
declared an Underground Utility District and is designated as Underground
Utility District No. 18 of the City of Costa Mesa. Attached hereto marked
Exhibit "A" and hereby incorporated as a part of this Resolution is a map
delineating the boundaries of said District.
BE IT FURTHER RESOLVED that the Council does hereby fix May 31, 1989,
as the date on which affected property owners must be ready to receive
underground service, and does hereby order the removal of all poles,
overhead wires, and associated overhead structures, and the underground
installation of wires and facilities for supplying electrical, communica-
tion, or similar or associated service within Underground Utility District
No. 18 on April 1, 1989.
BE IT FURTHER RESOLVED that the following exception in said Under-
ground Utility District No. 18 be, and they are hereby authorized:
(1) Any Municipal facilities or equipment installed under the super-
vision and to the satisfaction of the City Engineer.
(2) Poles or electroliers used exclusively for street lighting (or
traffic signals).
(3) Overhead wires (exclusive of supporting structures) crossing any
portion of a District within which overhead wires have been
prohibited, or connecting to a building on the perimeter of a
District, when such wires originate in an area frau which poles,
overhead wires, and associated overhead structures are not pro-
hibited.
(4) Antennae, associated equipment, and supporting structures, used
by a utility for furnishing cannunication services.
(5) Equipment appurtenant to underground facilities such as surface -
mounted transformers, pedestal -mounted terminal boxes and meter
cabinets, and concealed ducts.
(6) Temporary poles, overhead wires, and associated overhead struc-
tures used or to be used in conjunction with construction
projects.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property within
Underground Utility District No. 18 of the adoption of this Resolution
within ten (10) days after the date of such adoption. Said City Clerk
shall further notify said property owners of the necessity that, if they
or any person occupying such property desires to continue to receive elec-
tric, communication, or other similar or associated service, they or such
occupant shall, by the date fixed in this Resolution, provide all necessary
facility changes on their premises so as to receive such frau the lines of
the supplying utility or utilities at a new location, subject to applicable
rules, regulations, and tariffs of the respective utility or utilities on
file with the Public Utilities Commission of the State of California. Such
notification shall be made by mailing a copy of this Resolution, together
with a copy of said Sections 13-684 through 13-700 of the Costa Mesa
Municipal Code, to all affected property owners as such are shown on the
last equalized assessment roll and to the affected utilities.
BE IT FINALLY RESOLVED that the City Council hereby finds and deter-
mines as follows:
The Underground Utility District herein created is in the general
public interest for the following reasons:
(1) The undergrounding will avoid or eliminate an unusually heavy
concentration of overhead distribution facilities.
(2) The streets and rights of way in the District are extensively
used by the general public and carry a heavy volume of pedestrian
and vehicular traffic.
