A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION
PA -88-144 AND ZONE EXCEPTION PERMIT ZE-77-246A3.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, Section 13-227 of the City of Costa Mesa Zoning Code requires
public hearing and approval of any projects within the TC (Town Center)
zone by both the Planning Ccnmission and the City Council; and
WHEREAS, on October 10, 1988, the Planning Commission conducted the
required public hearing and recommended to the City Council approval of
Planning Action PA -88-144, a request for a 20 -story, 436,000 -square -foot
office building, with a parking structure containing approximately 1,500
spaces; arra Zone Exception Permit ZE-77-246A3, an amnendment to the Town
Center Master Plan to allow 3.2 million square feet of building area, based
on Findings and subject to conditions, as contained within the Planning
Division Staff Report; and
WHEREAS, on October 31, 1988, the City Council also conducted the
required public hearing and found that Draft EIR No. 1041, camients,
responses, and errata sheets, which collectively constitute Final EIR No.
1041, have been reviewed and considered, and that mitigation measures have
been incorporated into the project that eliminate or substantially lessen
the significant environmental effects thereof as identified in the Final
EIR arra the Statement of Facts and Findings; and that any remaining sig-
nificant effects on the environment found to be unavoidable have been
balanced against the benefits of the project and against the project alter-
natives and that those benefits have been found to be overriding, as set
forth in the Statement of Overriding Considerations. The mitigation meas-
ures applicable to this project and incorporated by reference into the
Statement of Facts and Findings are hereby made Conditions of Approval; and
WHEREAS, the required environmental review for the project was pro-
cessed in accordance with the requirements of the California Environmental
Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa that the proposed project, Planning Action PA -88-144 and Zone
Exception Permit ZE-77-246A3, be approved as clarified and modified below
based on the above recitals and subject to conditions, including the appli-
cable mitigation measures, as contained within the Planning Division Staff
Report:
1. PA -88-144 is approved as described above with the additional
clarification that the building may have up to 21 stories but
may not exceed 288 feet above existing grade;
2. ZE-77-246A3 is approved with modifications to retain the exist-
ing maximum building intensity of 3.0 million square feet but to
allow a reallocation of building area within individual develop-
ment blocks to allow for a 436,000 -square -foot office building
and a 196,743 -square -foot hotel.
