RESOLUTION NO. 88-101
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
oDSTA MESA, CALIFORNIA, APPROVING VESTING TENTA-
TIVE PARCEL MAP VS -88400.
WHEREAS, Vesting Tentative Parcel Map No. VS -88-400 has been filed,
which would create one, 5.14 net acre, parcel from two parcels, pursuant to
the provisions of the City's Planning, Zoning and Development Code; and
WHEREAS, after notice issued pursuant to the provisions of the City's
Planning, Zoning and Development Code, a public hearing was held on Novem-
ber 28, 1988, by Planning Commission and on December 5, 1988, by City
Council, at which time all interested parties were given an opportunity to
be heard and present evidence.
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
find, determine, and resolve as follows:
1. That the creation of one lot and related improvements is consis-
tent with the City's General Plan, and Planning, Zoning and Development
Ordinances.
2. The proposed use of the lot is for a -two-story, 80,000 square
foot, high-tech building, which is compatible with the objectives,
policies, general land use, and programs specified in the General Plan.
3. That the subject property is physically suitable to accommodate
Vesting Tentative Parcel Map No. VS -88-400 in terms of type, design and
density of development, and will not result in substantial envoirnmental
damage nor public health problems, based on compliance with the City's
Development Code and General Plan, and consideration of information con-
tained in the project's Final EIR (April 7, 1980 for ZE-80-26).
4. That the design of the subdivision provides, to the extent feasi-
ble, for future passive or natural heating and cooling opportunities in the
subdivision, as required by Government Code Section 66473.1.
5. That the creation of one, 5.14 net acre, parcel and associated
improvements will not be materially detrimental to property values,
jeopardize, endanger, or otherwise constitute a menace to the surrounding
area due to improvements required under Planning Action ZE-80-26A9 as well
as the EIR certified for ZE-80-26.
6. That the division and development of the property will not
unreasonably interfere with the free and complete exercise of the public
entity and/or public utility rights of way and/or easements within the
tract.
7. The discharge of sewage from this land division into the public
sewer system will not violate the requirements of the California Regional
Water Quality Control Board pursuant to Division 7 (Commencing with Section
1300 of the Water Code).
8. That the City Council does hereby declare that the EIR has been
completed in compliance with CEQA and State Guidelines. The City Council
further finds that the approval of this Vesting Tentative Parcel Map will
not have a significant adverse environmental impact.
9. For the foregoing reasons, the City Council of the City of Costa
Mesa does hereby approve Vesting Tentative Parcel Map No. VS -88-400 subject
to the attached conditions marked Exhibit "A', which are necessary to
protect the public health, safety, and general welfare in the area.

The vested rights conferred by VS -88-400 shall be
consistent with City Council action on ZE-80-26A9.
Two copies of the Final Map and traverse closure
calculations shall be submitted to the City of Costa
Mesa, Engineering Division for checking.
Per requirements of Real Property, City of Costa Mesa,
Engineering Division, submit Title Report Update of
subject property.
Submit nine copies and one duplicate mylar of recorded
map to Engineering Division, City of Costa Mesa, prior
to occupancy.
At the time of development submit for approval a
Grading Plan to the Engineering Division and Building
Department that shows Sewer, Water, existing Parkway
Improvements and the limits of work on the site, and
hydrology. calculations, both prepared by a Civil
Engineer. Rough grade approval must be obtained prior
to Building or Engineering Permits being issued by City
of Costa Mesa. The extent of topography on this plan
shall be sufficient to determine drainage impacts to
adjacent properties. Pay Grading Plan Check fee.
A permit and deposit will be required by City of Costa
Mesa, Engineering Division, prior to start of any on -
or off-site work, upon subsequent development of the
parcels.
Maintain the site in a "wet -down" condition to the
degree necessary to prevent excessive dust.
Periodically remove spillage from the public right-of-
way by sweeping or sprinkling, at the time of
development.
Haul routes must be approved by City of Costa Mesa,
Engineering Division, prior to approval of Rough Grade
Permit, upon development.
Private on-site drainage facilities and parkway
culvents or drains will not be maintained by the City
of Costa Mesa; they shall be maintained by the owner
or developer of the property. Private lateral
connections to City storm drains will require a Hold
Harmless Agreement prior to issuance of permit.
Fulfill mitigation of off-site traffic impacts prior
to issuance of Building Permit by submitting to the
Engineering Division the required cash deposit for
Development Trip Charges pursuant to the prevailing
schedule of charges adopted by the City Council.

SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special district are hereby
forwarded to the applicant:
Sani. 1. Developer will be required to construct sewers to serve
this project, at his own expense, meeting the approval
of the Costa Mesa Sanitary District.
2. County Sanitation District fees, fixture fees, and
sewer permit required prior to installation of sewer.
3. Developer is required to submit a plan showing sewer
improvements to the District Engineer's Office - (714)
631-1731.
