HomeMy WebLinkAbout89-16 - Amending Retirement Plan for Safety Employees181 RESOLUTION NO. 89-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING THE RETIREMENT PLAN FOR SAFETY EMPLOYEES OF THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE, DETER- MINE, AND ORDER AS FOLLOWS: WHEREAS, the Retirement Plan for Safety Employees of the City of Costa Mesa was established July 1, 1962; amended and restated in its entirety, effective January 1, 1984; and amended July 3, 1988, is hereby amended as follows: SECTION 1.10 is hereby amended per Exhibit "A" attached. NOW, THEREFORE, BE IT RESOLVED that the effective date of this amend- ment shall be February 6, 1989. BE IT FURTHER RESOLVED that nothing contained in this amendment to the restated Retirement Plan shall be held to alter or affect any of the provi- sions of this Plan other than as herein specifically provided. (fz&..j & aL�� City Clerk and ex -officio Clerk of the City Council of the City of Cos sa Ir5 EXHIBIT "A" RESOLUTION NO. 89-16 AMENDMENT TO THE RETIREMENT PLAN FOR SAFETY EMPLOYEES OF THE CITY OF COSTA MESA The "Retirement Plan for Safety Employees of the City of Costa Mesa", established July 1, 1962; which was amended and restated in its entirety, effective January 1, 1984; and amended July 3, 1988; is hereby amended, effective February 6, 1989, as follows: (1) By DELETING the text of Section 1.10 and SUBSTITUTING therefor the following: 1.10 "Monthly Earnings" means the rate of regular basic monthly earnings from the Employer, excluding bonuses, overtime pay, and all other forms of extra compensation, except that any portion of the Participant's contribution as defined in Section 8.1 which is paid by the Employer shall be included in the Monthly Earnings for all Participants terminating employment on or after January 1, 1981, provided, however, that no portion of the contribution which is paid by the Employer and/or the Participant to provide for the Total and Permanent Disability retirement benefit pursuant to Section 4.4 here- of shall be included in a Participant's Monthly Earnings.
