A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ADOPTING GENERAL PLAN
AMENDMENT GP --89-1B, AMENDING THE MASTER PLAN OF
HIGHWAYS IN NORTH COSTA MESA.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, the General Plan, including a Transportation Element and
Master Plan of Highways, was adopted by the City Council of the City of
Costa Mesa by Resolution No. 81-67 on July 20, 1981; and
WHEREAS, the General Plan is a long-range, comprehensive document
which serves as a guide for the orderly development of Costa Mesa; and
WHEREAS, by its very nature, the General Plan needs to be updated and
refined to account for current and future community needs; and
WHEREAS, the City has conducted the North Costa Mesa Arterial Improve-
ments Study to identify arterial improvement projects necessary to provide
standard service levels to peak period traffic forecast through the year
2010; and
WHEREAS, amendments to the City of Costa Mesa Master Plan of Highways
are recommended to decrease Master Plan designations at two locations, to
leave unchanged Master Plan designations at five locations, and to increase
Master Plan designations at 17 locations as noted in attached Exhibits "A'
and "B"; and
WHEREAS, Draft Program Environmental Impact Report No. 1037 was com-
pleted to identify impacts and mitigation measures for the arterial improve-
ment projects and Master Plan of Highways Amendments;
WHEREAS, a Statement of Facts and Findings, a Statement of Overriding
Considerations, and Conditions of Approval/Inventory of Mitigation Meas-
ures, attached hereto as Attachments A, B, and C, respectively, were pre-
pared pursuant to Environmental Impact Report No. 1037 and the requirements
of the California Environmental Quality Act;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa does recognize the need for standard service levels on North
Costa Mesa arterials and, as a result, adopts General Plan Amendment
GP -89-1B to amend the Master Plan of Highways as indicated in the attached
Exhibits "A" and "B".
BE IT FURTHER RESOLVED that the attached Statement of Facts and Find-
ings (Attachment A), Statement of Overriding Considerations (Attachment B),
and Conditions of Approval/Inventory of Mitigation Measures (Attachment C),
are hereby adopted.

STATEMENT OF FACTS
SIGNIFICANT ENVIRONMENTAL EFFECTS OF THE
PROPOSED PROJECT, FINDINGS WITH RESPECT TO
SAID EFFECTS, AND STATEMENT OF FACTS IN
SUPPORT THEREOF, ALL WITH RESPECT TO THE
PROPOSED NORTH COSTA MESA SPECIFIC PLAN
ARTERIAL IMPROVEMENT STUDY AND GENERAL PLAN
AMENDMENT GP -89-1B IN THE CITY OF COSTA MESA.
BACKGROUND
State CEQA Guidelines (Guidelines) promulgated pursuant to the
California Environmental Quality Act (CEQA) provide in part:
"No public agency shall approve or carry out a project
for which an EIR has been completed which identifies one
or more significant effects of the project unless the
public agency makes one or more written findings for each
of those significant effects, accompanied by a brief
explanation of the rationale for each finding."
The City of Costa Mesa proposes to adopt.the North Costa Mesa
Specific Plan Arterial Improvement Study as a preliminary
engineering and planning document, and to approve construction of
roadway improvements at certain Project Areas in order to improve
levels of service through year 2010. In addition, the City
proposes to adopt a General Plan Amendment GP -89-1B for nineteen
of the Project Areas described in the Arterial Improvement Study.
Because the proposed actions constitute a project under CEQA and
the Guidelines, the City of Costa Mesa has prepared a Program
Environmental Impact Report (SCH #87072917) which includes an
Addendum. The Program EIR identifies certain significant
environmental effects which may occur as a result of the project.
Furthermore, the City Council has determined not to implement
improvements at Project Area Nos. 21, 23 and 24, as these locations
are projected to maintain acceptable levels of service through year
2010, and, if implemented, would result in significant land use
impacts. Therefore, findings are set forth herein pursuant to
Section 15091 of the CEQA Guidelines. Conditions of Approval,
provided in Attachment "C", are based on mitigation measures in the
Final EIR. To ensure compliance with the mitigation measures as
required by Section 21081.6 of the Public Resources Code, a
reporting and monitoring program shall be adopted by the City of
Costa Mesa. The program shall consist of a detailed written report
for each Project Area outlining the method by which each applicable
mitigation measure will be carried out, dates of completion and a
list of the individuals responsible for the monitoring report.

Land use impacts created by the project will involve temporary
construction activity effects such as reduced access to some
business uses and lane closures. However, mitigation measures will
reduce short-term impacts to insignificant levels. Various long-
term impacts will occur due to right-of-way acquisition, including
loss of frontage and parking for commercial areas, residential
frontage loss, reduced access at commercial and residential areas,
loss of commercial and residential structures, and loss of
landscaping.
Finding
(a) Changes have been required in, or incorporated into, the
project which avoid or substantially lessen the
significant environmental effect as identified in the
Final EIR.
Facts in Support of Finding
As detailed in Attachment "C" and in the Final EIR (pages 102-
113, the Addendum, and Responses to Comments), land use
impacts will be mitigated to the extent feasible. Short-term
impacts will be mitigated by maintaining access for commercial
and residential areas at all times (short-term impacts are
also mitigated through measures described in Circulation and
Access, Climate and Air Quality, Noise and Public Services and
Utilities). Long-term impacts will be mitigated through
provision of compensation, as determined through a property
appraisal and fiscal assessment for each affected parcel, as
appropriate. Buffer/noise walls may be provided to offset
frontage loss. A parking variance or alternative parking may
be provided where resultant parking is below the minimum
required. Relocation assistance will be provided as
appropriate, pursuant to State and local law. Residential
relocation and access mitigation are not required, although
identified in the Final EIR, because locations where this
would have been necessary are not proposed for approval with
this Resolution (see below). Additional study and approval
may be necessary where structure acquisition and demolition
are required and will conform with applicable Federal, State
and local laws.
The City of Costa Mesa has determined that implementation of
improvements at Project Area Nos. 21, 23 and 24 is not
necessary at this time, as adequate levels of services are
projected for these areas through the year 2010. These
proposed improvements would have resulted in significant
right-of-way acquisition, loss of commercial and residential

Parking Code requirements, and access limitations. Therefore,
excluding these Project Areas from locations approved for
construction will avoid significant environmental impacts.
All significant environmental effects that can feasibly be
avoided have been eliminated or substantially lessened by
virtue of mitigation measures identified in the Final EIR and
incorporated into the project as set forth above and in
Attachment "C".
EFFECTS NOT MITIGATED TO AN INSIGNIFICANT LEVEL
Project implementation will result in the loss of four partial or
entire structures and parking stalls at several locations because
of right-of-way acquisition. Business losses may occur.
(b) Specific economic, social, or other considerations make

The unavoidable adverse impacts of the project are mitigated
to the extent feasible. At each specific Project Area,
necessary roadway improvements were determined based on
various constraints, including land use, public service and
utility facilities, and efficiency in transportation design.
The Project Area improvements set forth in the Final EIR are
considered the most desirable from a land use and
transportation perspective. As identified in the alternatives
section of the Final EIR, although other alternatives are not
precluded by the project (such as Transportation System
Management measures and improvements at additional locations),
the proposed project is considered a critical element in the
City of Costa Mesa's comprehensive effort towards providing
adequate traffic flow through the year 2010. The remaining,
unavoidable significant effect, if any, is acceptable when
balanced against facts set forth above and in the Statement
of Overriding Considerations which follows (Attachment "B").

SIGNIFICANT IMPACTS
The project will result in temporary access restrictions during
construction. However, with required mitigation measures, this
will be mitigated to less than significant levels. Long-term
effects will be positive, as the project provides for improved
traffic flow. However, Project Area Nos. 8 and 17 may experience
long-term access impacts. See below regarding access impacts at
Project Area No. 24.

additional locations), the proposed project is considered a
critical element in the City of Costa Mesa's comprehensive

and in the Statement of Overriding Considerations which
follows (Attachment "B").
CLIMATE AND AIR QUALITY
SIGNIFICANT IMPACTS
Short-term increases in dust will occur typical of construction
activity. However, no significant temporary or long-term air
quality impacts due to the project have been identified. Future
traffic levels will result in higher pollutant concentrations along
project roadways, which may result in the California standard for
Carbon Monoxide being exceeded. This is not, however, an impact
resulting from the project; on the contrary, the project is
expected to reduce air pollutant concentrations by making traffic
flow more efficiently.
Finding
No significant air quality impacts have been identified.
Facts in Support of Findina
Project construction will comply with applicable State and
local construction requirements to minimize dust and odor
generation. The project serves to provide regional air
emission reductions, as it allows for more efficient traffic
flow. As part of the City's comprehensive traffic improvement
program, which includes the proposed project, the City will
implement additional transportation measures which may further
improve local and regional air quality.

ATTACHMENT H
STATEMENT OF OVERRIDING CONSIDERATIONS
State EIR Guidelines (Guidelines) promulgated pursuant to the
California Environmental Quality Act (CEQA) provide in part:
"(a) CEQA requires the decision -maker to balance the
benefits of a proposed project against its unavoidable
environmental risks in determining whether to approve the
project. Where agencies have taken action resulting in
environmental damage without explaining the reasons which
supported the decision, courts have invalidated the
action."
"(b) Where the decision of the public agency follows the
occurrence of significant effects which are identified
in the Final EIR but not mitigated, the agency must state
in writing the reasons to support its action based on the
Final EIR and/or other information records. This
statement may be necessary if the agency also makes the
finding under Section 15091 (a)(2) or (3)."
"(c) If an agency makes a statement of overriding
considerations, the statement should be included in the
record of the project approval and should be mentioned
in the Notices of Determination." (Section 15094 of the
Guidelines.)
The City Council proposes to adopt the North Costa Mesa Specific
Plan Arterial Improvement Study, adopt General Plan Amendment GP -
89 -1B, and approve construction for all Project Areas except Nos.
21, 23 and 24. Because these actions constitute a project under
CEQA and the Guidelines, a Program Environmental Impact Report
(EIR) has been prepared by the City of Costa Mesa. The EIR has
identified certain significant effects that will follow from this
project even after incorporation of all feasible mitigation
measures.' After determining that the program EIR is complete and
has been prepared in accordance with CEQA and the Guidelines, and
making the Statements of Facts above, the City Council has also
weighed the significant effects of the project against the
overriding consideration noted as follows:
1. The North Costa Mesa Specific Plan Arterial Improvement
Study and Program EIR provide the City of Costa Mesa with
important environmental and preliminary engineering
design information for twenty-four locations in the City.
The General Plan Amendment would ensure that all proposed
improvements are consistent with the City's Master Plan
of Arterial Highways.

2. The project provides for adequate levels of service
through the year 2010 through implementing roadway
improvements at twenty-one locations in North Costa Mesa.
Two possible exceptions are Project Area Nos. 11 and 19.
However, level of service forecasts do not account for
traffic flow improvements which may be achieved through
bus turnouts and phasing, which may lead to acceptable
traffic flow. Adequate levels of service are essential
to the City's maintaining access for its residential,
commercial and industrial areas, in addition to
maintaining an acceptable quality of life for Costa Mesa
residents. Adequate traffic flow is also essential to
maintaining a viable commercial and tourism industry.
3. The project provides for bus turnouts as recommended by
the Orange County Transit District, which serves to
promote alternative transportation modes and reduce
regional vehicle emissions.
4. The project provides improved traffic flow along Harbor
Boulevard, a key element to the Orange County
Transportation Commission's "Superstreets" program,
designed to provide improved traffic flow along twenty-
one major arterials in Orange County.
5. Improved traffic flow will improve local and regional air
quality and will help to attain the objectives of the
SCAQMD for the South Coast Air Basin.
The City Council finds and determines that the above economic,
social and environmental considerations outweigh the significant
adverse environmental effects of the project.

ATTACHMENT C
CONDITIONS OF APPROVAL/INVENTORY OF MITIGATION MEASURES
LAND USE
1. In all cases, potential economic disruption to adjacent
businesses shall be minimized by maintenance of access to
businesses, proper detours and directional signing to
businesses, as determined necessary by the City of Costa Mesa
(see Section IV.B. of the Final EIR).
2. The City of Costa Mesa will need right-of-way from adjacent
land uses to implement the proposed roadway improvements,
which shall be acquired as necessary. Impacted properties
shall be appraised, and the value of land and structures shall
be assessed. In addition, an evaluation of severance,
potential loss of business as a result of the loss of
frontage, parking spaces and structures or portions of
structures shall be made. The following criteria shall be
used in determining appropriate mitigation measures for
specific land use impacts, as determined by the City on a
case-by-case basis and in cooperation with the affected
parties. All compensation shall be based on a property
appraisal and fiscal assessment of other land use impacts.
Commercial Land Uses
a. Loss of Frontage: Compensation shall be provided on a
unit cost basis (per square foot). In consideration of
potential land use, aesthetic and noise impacts, the City
may elect to provide buffer walls in lieu of or in
addition to monetary compensation, particularly where
resultant right-of-way is placed within 10 feet of an
occupied building.
b. Loss of Parking: Compensation shall be provided on a
unit cost basis for right-of-way acquisition. Where loss
of parking results in less than the minimum spaces
required in the City parking code, the City shall
consider issuance of a variance and may approve alternate
parking areas or provide other compensation (see Table
1 in the Final EIR) . It is estimated that restriping
remaining parking stalls as "compact" spaces can provide
up to one additional stall per five stalls restriped.

Residential Land U
a. Loss of Frontage: Compensation shall be provided on a
unit cost basis. In consideration of potential land use,
aesthetic and noise impacts, the City may elect to
provide buffer walls in lieu of or in addition to
monetary compensation, particularly where resultant
right-of-way is placed within 20 feet of an occupied
residential building.
b. Loss of Driveway Area: Compensation shall be provided
on a unit cost basis. The elimination of driveway
parking shall be partially mitigated by adding
hammerheads or loops to driveways, where deemed
necessary, due to shortened driveway lengths along the
roadway, to provide easier driveway access and additional
parking. The removal of driveway area along project
arterials could also be partially mitigated by financial
reimbursement to residents and/or provision of automatic
garage door openers that reduce congestion by allowing
quicker driveway access. The City may elect to acquire
the entire property.
Easements
a. Richt-of-Way Acquisition: Compensation shall be provided
on a unit cost basis.
3. Additional Study
In several project areas, right-of-way acquisition will
require demolition of structures and removal or relocation of
service station islands. An environmental assessment of these
properties will be required prior to their demolition,
relocation or removal, in order to minimize potential
environmental impacts (associated with potential presence of
hazardous materials in affected structures). Further study

is pending City determination of areas requiring improvement.
All demolition and removal activities shall comply with
applicable City and County requirements, South Coast Air
Quality Management District regulations, Regional Water
Quality Control Board requirements, State and Federal law
regarding demolition of structures, and applicable safety
requirements. Prior to demolition or removal, review and
approval by additional agencies may be necessary. With
adherence to applicable requirements, no significant impacts
are anticipated.
4. Using the preceding criteria as a guideline, the City of Costa
Mesa shall, in cooperation with affected parties, mitigate the
land use impacts for each Project Area. The Final EIR
provides a discussion of potential impacts for each Project
Area (based on Drawings 1-1 through 24-1, the Impact
discussion above and Table 1). Specific impacts at each
Project Area will require mitigation pursuant to the criteria
established in the program discussion above. If not otherwise
stated, right-of-way acquisition requires removal of frontage,
including landscaping, pavement and undeveloped areas.
CIRCULATION AND ACCE
5. Short -Term
Short-term impacts to building access and to intersection and
bike lane use shall be mitigated by a Traffic Control Program
to be established by the City of Costa Mesa. This program
shall consist of prior notices, adequate sign -posting,
detours, phased construction and temporary driveways where
necessary. Adequate access shall be provided at all times to
and from residences and businesses. Proper detours and
warning signs shall be established for bike lanes to ensure
public safety.
Construction activities shall proceed in a timely manner to
reduce impacts to.building access and bike lanes. The project
areas shall be improved in phases based on need (see Section
III.E. of the Final EIR).
6. Lona -Tena
The project itself may be considered mitigation for existing
and anticipated future traffic congestion. No further long-
term mitigation is proposed.
7. Please refer to Section IV.B. of the Final EIR for a
discussion of project area specific mitigation measures
regarding access.

CLIMAT
S. Short -Term Impa
Although no significant air quality impacts of the project
have been identified, construction of the proposed project
shall be required to be in compliance with SCAQMD Rule 403,
which will reduce fugitive dust amounts by up to 50 percent.
Dust reducing measures shall include regular watering of
graded surfaces, restriction of all construction vehicles and
equipment to travel along established and regularly watered
roadways, and requiring that operations which tend to create
dust be suspended during windy conditions. The project shall
also comply with SCAQMD Rule 402, to reduce potential nuisance
impacts due to odors from construction activities.
9. In addition to stationary source and land use controls
applicable to existing and future projects utilizing project
roadways, the following are applicable Transportation Source
Controls that have been identified in the City of Costa Mesa
General Plan (Environmental Resources/Management Element, page
23). The proposed project shall incorporate these measures
where applicable. It should be noted that the project is, in
itself, a mitigation measure for air quality impacts by
improving traffic flow.
a. Establish a computerized, integrated traffic signal
network for major thoroughfares.
b. Prohibit on -street parking along major arterials to
increase capacity and improve flow.
C. Modify intersections (turn restrictions, channelization,
etc.) to improve flow and increase capacity.
d. Restrict truck traffic during peak hours.
e. Provide bike lanes and/or trails system to encourage
reduction in motor vehicle trips.
f. Coordinate bikeway planning with transit stop locations.
g. Improve pedestrian and bicycle safety along local streets
and roads.
h. Reduce vehicular/bus conflicts by the construction of bus
bays to remove buses from traveled lanes.

Although visual impacts will occur with implementation of the
proposed arterial improvements, most are short-term in nature and
will not persist after completion of construction -related
activities (please refer to Section IV.A. of the Final EIR for
additional mitigation measures related to aesthetics). Other more
permanent impacts shall be mitigated by the following measures (no
significant impacts of these measures have been identified):

13. New sidewalks and curbs shall be provided where existing
sidewalk is removed for roadway widening.
14. Landscaping removed by road widening shall be replaced on-
site, where feasible, by similar species in appropriate
locations. Where replacement of landscaping and trees is not
possible in the immediate vicinity of the affected area,
replacement shall be provided in adjacent or "off-site" areas
to enhance other areas and offset project impacts.
15. To the extent feasible, drought -tolerant plant materials shall
be used for new landscaping material.
NOISE
16. Project construction and ongoing activities shall comply with
the City Noise Ordinance. Specifically, the project will be
required to limit construction hours to between 7:00 a.m. and
8:00 p.m.
17. In areas where projected traffic levels may affect qualifying
existing residential areas, noise mitigation will be provided
in accordance with the Arterial Highway Wall Master Plan, as
described in Section XIV.C. of the Final EIR.

18. Where intersection improvements shall impact utility and
service lines and appurtenances, the City of Costa Mesa shall
modify the facilities or work with the appropriate agency to
accommodate intersection expansions. These modifications
include moving electric, gas, television, water and sewer
lines. In addition, manholes, meters, boxes, storm drains and
fire hydrants shall be adjusted to street grade. Several
street lights, telephone and power poles and street signs
within the project areas must also be moved. Facilities shall
be relocated but will not be eliminated. Final engineering
design shall be such that all public service and utility
agency facilities are protected and/or adjusted per the
applicable design standards.
19. The City shall coordinate with utility and service
organizations to avoid disruption of service as a result of
project implementation.
20. Underground Service Alert, an organization which alerts
underground utility companies of excavation near their
facilities, shall be notified prior to intersection
improvement.
21. All bus turnouts shall be designed in accordance with
applicable City standards and Orange County Transit District
design guidelines.
22. Design plans shall be forwarded to the Mesa Consolidated Water
District, the Orange County Water District and Metropolitan
Water District for Project Areas affecting their facilities.
The City shall, to the extent possible, ensure that the
existing MWD O.C. feeder extension pipeline is not disrupted.
Final engineering design and project construction shall
consider available design information for the future Orange
County Water District Green Acres Project.
23. Encroachment into flood control channel(s) shall be subject
to approval by the appropriate agency and will maintain or
improve existing facilities and flood control provided, which
may be necessary at Project Area Nos. 1, 5 and 6.
Improvements at Project Area Nos. 5 and 6 may affect Orange
County Flood Control District facilities, while improvements
at Project Area No. 1 may affect a flood control channel owned
by the cities of Costa Mesa and Santa Ana.
24. Encroachment into the power easement shall be subject to
Southern California Edison Company approval.

and the City and County Police and Fire Departments at least
